SAN FRANCISCO, CA / ACCESSWIRE / February 22, 2024 / A married couple filed a lawsuit today in the Northern District of California against CooperSurgical, Inc. and The Cooper Companies, Inc. The lawsuit alleges that CooperSurgical, which manufactures, markets and sells products to fertility clinics, sold a defective embryo culture media designed to support the growth and development of embryos created through in vitro fertilization (IVF). The couple alleges that this defective culture media destroyed or damaged nine of their embryos during the IVF process. The lawsuit was filed by the law firms Girard Sharp LLP and Sauder Schelkopf LLC.
In December 2023, CooperSurgical recalled certain lots of its embryo culture media after the company became aware of "a sudden increase in complaints" regarding this product. It acknowledged that the "risk to health is impaired embryo development prior to the blastocyst stage," and directed clinics that purchased the product to quarantine and return it.
The couple filing the lawsuit were notified in January 2024 that all of their destroyed embryos were exposed to CooperSurgical's defective culture media. According to a New York Times article on the recall, "as many as 20,000 patients could have been
affected."
The Cooper Companies owns CooperSurgical and other global medical device manufacturing companies. Neither The Cooper Companies nor CooperSurgical have publicly stated if the necessary testing and quality control was in place to identify defective culture media. Proper testing could have prevented this tragedy.
