Wilmington, NC, September 6, 2016: The Family of NC Pedestrian LaColtus Grady Struck by Domino’s Delivery Driver Seek Justice. Today Attorney Thomas Bowers and his legal team, representing the family of LaColtus Grady filed a $100 million lawsuit in the New Hanover County District Court against both Domino’s Pizza and negligent driver Brittany Boddiford .


On Thursday, May 5, 2016, 22-yr old Domino’s Driver Boddiford was en route returning to the Domino’s Pizza store on Carolina Beach Road when she drifted into oncoming traffic fatally wounding Grady. The fatal accident involving the pedestrian Grady who was standing by his car in front of his parents’ house was as a result of the driver losing control of her vehicle while reaching for her cell phone. Grady was transported to the local hospital where he was later pronounced dead. Family members of the only child Grady remain in shock months later trying to make sense out of this incident.

The suit filed on behalf of Grady family members seeks reparations from defendant Domino’s Pizza and its driver for negligence and wrongful death, vicarious liability, gross negligence and punitive damages based upon willful and wanton conduct. Bowers stated, “We are representing the family because Domino’s knew this driver posed an extreme risk danger, yet they continued to let her work for Domino’s Pizza.” Boddiford had already received customer complaints about her speeding. The local management’s response was to have Boddiford call and apologize to the customers who complained. No additional training or disciplinary action were ever taken to relieve Boddiford from her duties as a driver when complaints were noted. “One customer told Domino’s that if Boddiford didn’t stop driving like that she would kill someone” remarked Bowers. The family including their legal team hope this case can prevent another similar incident. As Bowers put it, “a mother and father lost their child, there’s just no greater tragedy”.

Domino’s driver Boddiford has already pled guilty in criminal court to involuntary manslaughter in the tragedy. The arrest record also noted the possession of drugs in the vehicle Boddiford was driving.

Bowers has handled other high profile cases including lawsuits against billionaire Jerry Jones and the Dallas Cowboys and billionaire T. Boone Pickens. He has also represented Ahmed “clock boy” Mohamed and the family of police shooting victim Philando Castile.
