Remithome(R) Wins Decision Against Indian Company's Use of Remit2Home.com

- remithome Corporation Lavinia Hong, 510-268-9950 lavinia.hong@remithome.com On February 21, 2008, a panel of the National Arbitration Forum ordered that the domain names remit2home.com and remit2home1.com be transferred from Times of Money Ltd., a Mumbai, India-based company, to remithome Corporation, a U.S. to Philippines online remittance service based in Oakland, California (www.remithome.com).

The panel ruled in favor

of remithome, finding that remit2home.com and remit2home1.com were confusingly similar to remithome Corporation's registered REMITHOME mark. The panel noted that adding the number "2" in the center of the mark does not render the domain names distinct from the established REMITHOME trademark.

The panel also found that Times of Money lacks rights and legitimate interests in remit2home.com and remit2home1.com and "simply used the domains to redirect traffic to a website comprising their actual business name, Times of Money."

Finally, the panel found that "bad faith registration and use" is indicated because Times of Money "profits from this website, and is thus taking commercial advantage of this likelihood of confusion ... ." The finding that Times of Money had "actual or constructive knowledge" of remithome Corporation's rights in the REMITHOME mark prior to registering the domain names provides further evidence of registration and use in bad faith.
