Metro Waste LLC Files Complaint against Former Employees for Alleged Theft of Property

- Ray Quinney & Nebeker Justin Toth, 801-323-3343 Metro Waste LLC today announced that it has filed a complaint in the Third Judicial District Court in Salt Lake County, Utah against a group of former employees, which alleged that millions of dollars were illegally diverted from the company over a number of years. Parties named in the suit include the estate of the late Arthur ("Dick") Chatterton, a founder and former board member, one of Chatterton's sons and several other employees.

Plaintiffs Metro Waste and affiliated entities are pursuing in excess of $3.5 million in direct damages resulting from the alleged losses and at least $5 million in punitive damages. The plaintiffs allege that the defendants engaged in a scheme to systematically divert materials from Metro Waste's recycling plant and sell them for personal gain.

Metro Waste was founded in 1999 by Dick Chatterton and a partner and took on several investors. The company's primary activity is to gather waste from commercial waste canisters and construction sites, remove recyclables and deposit the remaining waste in the company's proprietary landfill located west of Salt Lake City.

"We are very disappointed with what has come to light, and we are fully committed to protecting the interests of those who may have been damaged," said Tim Layton, a director of Metro Waste. "This complaint is an earnest effort to right a serious wrong and to restore to Metro Waste and its shareholders that which was lost."

Metro Waste is being represented in its suit by the Salt Lake City law firm Ray Quinney & Nebeker P.C.
