2008-09-07 08:48:26 - MANILA. Philippines Bureau of Immigration to deport British pedophile

The Bureau of Immigration (BI) is poised to deport a British pedophile who is a wanted sex convict in his country.

Immigration commissioner Marcelino Libanan on Sunday said the pedophile, identified as Kriss McCord, will be expelled pursuant to a summary deportation order that the BI board of commissioners issued against him last Feb. 28.

'He (McCord) filed a motion for reconsideration of the deportation but the board denied his plea, hence paving the way for his deportation,' the BI chief said.

Libanan said McCord is a fugitive long wanted by authorities in Great Britain where he was convicted on three counts of rape and four counts of indecent assault.

He added the Briton was placed in the immigration blacklist and banned from re-entering the Philippines for being an undesirable alien.

Records showed that McCord was arrested by joint operatives of the BI and Philippine Center for Transnational Crimes in Llanera, Nueva Ecija on Dec. 8, 2006.

The passport that he presented to the arresting agents turned out to be spurious as it contained fake Balikbayan and immigration arrival stamps. He was also overstaying at the time of his arrest.

According to the Interpol, a court in Nottingham, England sentenced McCord to a prison term of nine years in June 1999 after finding him guilty of violating Great Britain's sexual offenses act.

He was later released on parole but he violated the conditions of his release by traveling abroad without notifying the British authorities as required by law.

McCord filed an appeal against the conviction of three counts of rape and three counts of indecent assault against a young girl with the Court of Appeal in London.

However, Lord Justice Auld, sitting with Mr Justice David Clarke and Mr Justice Christopher Clarke in April of 2006 rejected the appeal, saying McCord had been accused of carrying out the sexual assaults in the late 1980s when the girl was aged from 11 to 16 years old.

Dismissing the appeal, Lord Justice Auld said: "We do not consider that there are any arguable grounds of appeal, and the court will therefore deal with this matter by refusing this application."

It was also gathered that McCord's lawyer filed a petition for a writ of amparo with the Court of Appeals after his deportation order was issued.

The said petition was denied by the appellate court on March 12, 2008 on the ground that the Briton was already charged and ordered deported by the BI for violating the country's immigration law.
