Law office of Brodsky & Smith, LLC announces that it is investigating potential claims against the Board of Directors of Waste Services, Inc.

(“Waste Services” or the “Company”) (Nasdaq:WSII) relating to the proposed merger with IESI-BFC Ltd. (“IESI-BFC”).

Under the proposed agreement, Waste Services shareholders will receive 0.5833 shares of IESI-BFC stock for each share of Waste Services they own. The

investigation concerns possible breaches of fiduciary duty and other violations of state law related to the Waste Services Board’s approval of the proposed acquisition. The proposed merger may under value Waste Services, which has initiated a vertical integration strategy centered on the JED landfill, one of the most valuable solid waste assets in Florida. This has resulted in the Company’s steady improvements in Florida and an adjusted EBITDA margin of 27.2% in the third quarter ended September 30, 2009.

If you own shares of Waste Services and wish to discuss the legal ramifications of the proposed acquisition, or have any questions, you may e-mail or call the law office of Brodsky & Smith, LLC who will, without obligation or cost to you, attempt to answer your questions. You may contact Jason L. Brodsky, Esquire or Evan J.
