Kirschner joins from O'Melveny & Myers, and in Washington D.C., Eric S. Dreiband, former general counsel of the EEOC, has come from Akin Gump.
These new arrivals come on the heels of several other substantial additions to the Labor & Employment practice over the last year, including most recently:
- In Irvine, CA - Robert Naeve and Steven Zadravecz joined from Morrison & Foerster in March, 2008.
- In Washington D.C. - M. Carter DeLorme joined from Winston & Strawn in June, 2008.

Mr. Kirschner's practice will focus on the resolution of complex labor and employment disputes, with a particular emphasis in the health care field. As the designated outside labor counsel to the American Hospital Association and as counsel for several health care employers, he has handled some of the most challenging labor and employment law disputes facing employers today. The range of Mr. Kirschner's traditional labor experience is broad, covering both the public and private sector, as well as small and large bargaining units. He has represented employers in scores of employment lawsuits in state and federal courts throughout California, obtaining successful outcomes before both judges and juries, in many industries, including broadcasting, technology, engineering, airline, and investment banking.
Mr. Kirschner received his B.A. from the University of California at Berkeley, with distinction where he was Phi Beta Kappa, and his J.D. from the University of Michigan, cum laude, where he was awarded the Clara Belfield Fellowship.
In Washington, Mr. Dreiband currently represents companies in all aspects of civil rights, employment discrimination, and wage and hour litigation. From 2003 to 2005, he served as the general counsel of the U.S. Equal Employment Opportunity Commission. In that capacity, he directed the federal government's litigation of Title VII of the Civil Rights Act of 1964, the Equal Pay Act, the Age Discrimination in Employment Act, and the Americans with Disabilities Act. Prior to becoming EEOC general counsel, Mr. Dreiband served as deputy administrator of the U.S. Department of Labor's Wage and Hour Division. During this time he directed the federal government's enforcement of the Fair Labor Standards Act, the Family and Medical Leave Act, the Migrant Seasonal Agricultural Worker Protection Act, and other federal labor laws. For his contribution to the DOL's efforts to update the Fair Labor Standards Act's overtime exemption regulations, he received the Secretary of Labor's Exceptional Achievement Award.
Mr. Dreiband received his A.B. from Princeton University and his M.T.S. from Harvard University. He received his J.D. with honors from the Northwestern University School of Law.
