JOE PESCI is suing producers of the upcoming Gotti family biopic for $3 million (£1.8 million) after he was allegedly pushed out of the movie.
The Goodfellas star signed up to play Angelo Ruggiero, the enforcer of mob boss John Gotti, played by John Travolta.
He agreed to the lucrative deal and claims he was so convinced the film was going ahead with him as a main part, he piled on 30 pounds (13.6 kilograms) for the role.
But in papers filed in a Los Angeles court on Wednesday (27Jul11), Pesci claims bosses reneged on an agreement to cast him.
He states he was subsequently offered $1 million (£625,000) to play a lesser role, but is seeking his agreed pay cheque, as well as damages.
However, bosses at Fiore Films, the studio behind the movie, insist it was Pesci who pulled out of the project after learning the original director had dropped out. Pesci’s lawyer denies the claims.

JESSE JAMES’ ex-wife JANINE LINDEMULDER has been arrested just two days after she lost custody of their daughter.
The former couple, which split in 2004, has been embroiled in a nasty legal battle over seven-year-old Sunny for years and James was initially awarded custody in 2009 when Lindemulder was jailed on tax evasion charges.
She was placed behind bars again in Austin, Texas earlier this year (11) for allegedly harassing the TV mechanic in a series of threatening emails and voicemails, and earlier this week (begs25Jul11) a judge in California gave James sole custody of the child.
On Wednesday (27Jul11), Lindemulder was arrested for allegedly harassing the star again, with TMZ.com claiming she had called the reality TV star more than 25 times a day.

GREY’S ANATOMY actress SARAH DREW will be heading to a hospital for real next year (12) - she’s pregnant with her first child.
The 30 year old, who plays Dr. April Kepner on the hit medical show, is expecting a baby with her husband, Peter Lanfer.
Drew and Lanfer will become first-time parents in January (12).
The news comes just a month after her co-star Eric Dane announced his wife Rebecca Gayheart is expecting again.

Grieving KELLY OSBOURNE has lashed out at her ex-fiance LUKE WORRALL after he allegedly mocked her on Twitter.com while she attended late pal AMY WINEHOUSE’s funeral.
The reality TV star jetted from the U.S. to the U.K. to be with the tragic singer’s family following the news of her death on Saturday (23Jul11), and she was one of the mourners at Winehouse’s private memorial on Tuesday (26Jul11).
Osbourne took to her Twitter blog after the service, branding the day the "saddest" of her life, but things turned from bad to worse for the rock offspring when she discovered her former beau had been posting nasty comments about her on the social networking site.
A furious Osbourne returned to her webpage and lashed out at Worrall, accusing him of hitting a "new low" and of only dating her for her money.
She writes, "@luke_worrall you’ve made it very clear u (sic) only dated me 4 (sic) my life style but s**t tweets about me the day im @ (at) a funeral u have hit a new low.
"It was fine when my Kellyphant a** was paying 4everything (sic) wasn’t it? I just didn’t think u could get much lower but u did #wow." She later added that she was considering shutting down her Twitter account altogether: "Dont think i want a twitter page anymore the fact that ppl (people) get joy from being mean 2 me makes me sick whats (sic) the point? there is to (sic) much evil." The star split from Worrall last year (10) amid rumours he cheated on her with a transgender model.

Tragic soul star AMY WINEHOUSE has returned to the U.S. albums chart from beyond the grave - her critically-acclaimed BACK TO BLACK has re-entered the Billboard 200 at number nine.
Fans have been flocking to buy Winehouse’s music following her death on Saturday (23Jul11) and the sudden surge in sales has propelled the Grammy Award-winning disc back into the top 10. Her debut release, 2004’s Frank, is also climbing up the chart at 37.
Meanwhile, fellow Brit Adele claims her 11th non-consecutive week at number one - 21 bumps Blake Shelton’s Red River Blue from the top spot to sixth place.
Children’s music franchise Kidz Bop 20 is a new entry at two, while 3 Doors Down debut at three with Time of My Life.

MARK RONSON paid tribute to his late collaborator and pal AMY WINEHOUSE on Wednesday night (27Jul11) by playing her hits REHAB, VALERIE and BACK TO BLACK during a festival set in London.
Ronson, who produced the tragic star’s Grammy-winning album Back to Black, was left devastated by her death on Saturday (23Jul11), and cancelled his DJ set at the Cartier International Polo event in Windsor, England on Sunday (24Jul11).
After attending her funeral in London on Tuesday (26Jul11), Ronson returned to the stage at the Greenwich Summer Sessions in the U.K. capital, and honoured his "genius" friend by thrilling the crowd with a series of her best loved tracks.
He kicked off the set with Valerie, and brought The Zutons frontman Dave McCabe - who wrote the song - to perform vocals, before playing a stripped down version of Rehab. He then teamed up with Charlie Waller of The Rumble Strips for a rendition of Back to Black.
He told the crowd, "It’s been a s**t week and it’s great coming out to play to you guys, that’s the great thing about music.
"If you love Amy and her music make sure you clap your hands right now. I went to her service yesterday and a Rabbi said ‘a person’s life is measured in deeds, not years’; hers was pretty f**king special.
"I’m not getting emotional or morbid but it’s nice to share this moment with people who appreciate good music. Amy Winehouse was a genius and has made more brilliant music than I’ll ever make."

Rockers THE KILLERS broke into a university to work on songs for their bestselling debut album, 2004’s HOT FUSS.
The Human hitmakers first began rehearsing in drummer Ronnie Vannucci’s garage but their complicated work schedule meant they could only practice at night.
After struggling to find a suitable rehearsal studio, Vannucci decided to break into the music room at the University of Nevada and practice there.
He tells NME magazine, "We’d break into the percussion room, use all the stuff, and carefully put everything back. We practised for hours. I can remember writing Glamorous Indie Rock and Roll and Somebody Told Me in that room."

THE BEATLES’ original drummer PETE BEST has had a road in his native Liverpool, England named in his honour.
The musician spent two years as a member of the Fab Four before being replaced by Ringo Starr in 1962.
Fans have been campaigning over the last few years to land Best some recognition in his hometown and a Facebook.com petition attracted the support of over 10,000 people.
Officials in the city of Liverpool appear to have taken note of their efforts and they have now announced that Best will receive two local street honours - one called Pete Best Drive, and the other called Casbah Close in memory of his mother Mona, who set up The Casbah Club - the "birthplace" of The Beatles.
Best tells the BBC, "I feel very humbled, very flattered and very honoured that the city of Liverpool, council members and the people of Liverpool have thought to honour me in such a fantastic way.
"The Casbah Coffee Club was… the original birthplace of The Beatles on August 29, 1959. I just wish that she was still here to receive the honour herself…"

Actress JAYMA MAYS was tempted to wear the prosthetic pregnant belly she dons in new movie THE SMURFS during a night out - because she loved the special treatment she received from members of the public during filming.
The Glee star plays the pregnant wife of Neil Patrick Harris’ character in the live action family comedy and she was pleasantly surprised every time she stepped out on the streets of New York to shoot the film.
She tells WENN, "I was pregnant (in the role). I was wearing the (prosthetic) belly which was great by the way. People are so nice to you when you wear a belly, like (they) open doors for you or ask you if you’re hungry or need water. I did want to go to a bar with the belly on and just drink some shots!" But May admits walking around with the bulging belly felt a little strange, because it gave her a glimpse into her own future.
She adds, "I’ve had to wear a belly once before for a job and you look in the mirror and it’s weird and think, ‘one day,’ because I might have kids one day and this is what it’s gonna look like. I think it probably freaked my husband out more than it freaked me out."

Actor HANK AZARIA was forced to re-shoot scene after scene of his new movie THE SMURFS because the fake teeth he had to wear kept flying out of his mouth.
The Godzilla star spent the first two hours of his day in the make-up chair while shooting the family comedy to transform himself into the evil character Gargamel.
But he reveals his toothy grin caused a series of delays during production because the fake dentures wouldn’t stay put.
He tells WENN, "They gave me a set of teeth right in the special effects shop. Those teeth would fly out of my mouth a lot every time I yelled or any vibration would make them dislodge. Many a take was ruined because the teeth would come flying out, which was not a great moment." However, there was one part of his character’s behaviour that Azaria had fun with: playing around with his feline co-stars - although he assures animal lovers the pets were well looked after on set.
He says, "I find them amusing and I enjoyed throwing cats in the movie. No cats were harmed I must say but I did get to toss the cat quite a lot. The good thing is cats don’t care because they just land on their feet and move on as if they meant it to happen."

TRUE BLOOD hunk ALEXANDER SKARSGARD has joined the fight against homophobia by filming a public service announcement (PSA) calling on parents to "lead by example".
The actor and his TV co-stars Kristin Bauer van Straten and Rutina Wesley have joined forces with The Trevor Project, a suicide prevention organisation which provides support for youths in the lesbian, gay, bisexual and transgender community.
They have filmed individual commercials promoting the organisation’s motivational message, "It gets better".
In Skarsgard’s PSA, he says, "My name is Alexander Skarsgard and I believe that it gets better when parents start to lead by example. We have to teach our children that, not only through our words but also through our actions, that every single human being has equal value and to bully someone or force society to discriminate against someone because they have a different sexual orientation is unacceptable. I don’t have any children yet, but the day I do, I will make sure that they, before they can walk, before they can even crawl, know how important that is and I hope you do the same. It gets better."

Beloved U.S. quiz show host ALEX TREBEK has been left hobbling around on crutches after injuring himself while attempting to chase a burglar.
The veteran Jeopardy! presenter snapped his Achilles tendon on Wednesday morning (27Jul11) as he tried to catch a woman who had allegedly been snooping around his hotel room in San Francisco, California.
He hurt his other leg as he fell, but Trebek refused to let the accident stop him from hosting the nearby National Geographic World Championship and he assured attendees at the event that he was OK.
Police eventually captured the suspect, a 56-year-old woman, who was subsequently booked on charges of felony burglary and possession of stolen property.
She is accused of taking cash and a bracelet given to Trebek by his mother from his room, before trying to hide the stolen goods near an ice machine in the hotel.

Actor DOMINIC COOPER jumped at the chance to portray SADDAM HUSSEIN’s sadistic son in new drama THE DEVIL’S DOUBLE, because he was desperate to move away from his breakthrough role in movie musical MAMMA MIA!.
The British star insists he is grateful for the success of the hit film, but admits he has struggled to find more challenging roles since appearing as the all-singing, all-dancing Sky alongside Amanda Seyfried, Meryl Streep and Pierce Brosnan.
So he immediately snapped up The Devil’s Double, based on the book of the same name by Latif Yahia, an Iraqi man who was forced to act as the body double of troubled Uday Hussein.
Cooper, who portrays both Yahia and Hussein in the film, tells WENN, "I’d love people to see this because it was so rewarding and I worked so hard on this and it’s a low budget film. It’s nice to be seen in a different light I suppose…
"Up until now, in terms of my film work, I’ve enjoyed doing supporting roles but it’s quite problematic trying to sell yourself to get into any film you possibly can, but then you can be pigeon-holed. Being so fortunate that you end up in a musical film (Mamma Mia) that does extremely well, the opposite end of that is people think you’re all-singing, dancing and that’s what you do; you’re a musical theatre person. I’m really thankful to have the opportunity to be able to show a different side of what I can do."

Movie producer and set designer POLLY PLATT has died at the age of 72.
The star passed away on Wednesday morning (27Jul11) in Brooklyn, New York. She had been suffering from the motor neuron condition ALS (Amyotrophic lateral sclerosis), also known as Lou Gehrig’s Disease.
Platt, who was once married to filmmaker Peter Bogdanovich, served as executive producer on 1987 film Broadcast News and producer on 1989’s Say Anything.
She was also known for her set production skills and landed an Oscar nomination for her work on 1983’s Terms of Endearment.
Platt also worked on the set of Bogdanovich’s movies, including Targets, The Last Picture Show and Paper Moon.

Reality TV star TORI SPELLING regrets getting a boob job during her youth because she had no idea the procedure would affect her ability to breastfeed her children.
The former Beverly Hills, 90120 actress, who is currently pregnant with her third child, had a breast augmentation in her early 20s to boost her sex appeal as an actress.
However, Spelling wishes she had thought about undergoing the cosmetic surgery more carefully because the implants have had a negative impact on her role as a mum.
During an appearance on U.S. breakfast show Good Morning America on Wednesday (27Jul11), she said, "Well I got my boobs done… in my early 20s. If I had known that it would or could possibly impact production of (breast) milk, I wouldn’t have had them.
"I love being a mum. I’m on my third baby. We want to have more. Like, that’s my role. These (big breasts) don’t matter."

A man accused of stalking actress HALLE BERRY has been hit with an additional charge of burglary, stemming from his arrest at her Hollywood home earlier this month (Jul11).
Richard Franco was taken into custody after allegedly showing up at her estate three times in as many days.
He denied a charge of felony stalking, but prosecutors slapped him with another allegation of residential burglary on Wednesday (27Jul11).
He has pleaded not guilty to the second charge and is due to appear back in court on 4 August (11).
Berry obtained a temporary restraining order against Franco following the terrifying incident, which she claims left her "panicking" and "extremely frightened" for her safety.
If convicted, Franco faces up to three years behind bars for felony stalking, while the burglary charge carries a six-year sentence, according to TMZ.com.

Saxaphone player GIL BERNAL has died at the age of 80.
The musician passed away from congestive heart failure at a Glendale, California hospital on 17 July (11), reports the Los Angeles Times.
Bernal was known for his days in late jazz star Lionel Hampton’s band, before leaving to form his own group in the 1950s.
He went on to work with bandleader Spike Jones and appeared on Ry Cooder’s 1997 Cuban music release, Buena Vista Social Club.
However, he will perhaps be best known for his performance on 1950s hit Smokey Joe’s Cafe.

The cover art for NIRVANA’s classic 1991 album NEVERMIND has been banned from Facebook.com - the photo of a naked baby has been labelled as graphic content.
The picture of a swimming baby chasing a dollar bill underwater has become iconic, but the artwork was removed from the group’s official fan page shortly after music bosses posted the image online to commemorate the record’s 20th anniversary.
Executives at the social networking site claim the photo violates its terms of use clause.
The notice reads, "Facebook does not allow photos that attack an individual or group, or that contain nudity, drug use, violence or other violations of the Terms of Use." But the boy who posed for the photograph 20 years ago, Spencer Elden, has no qualms about the naked snap being used on Facebook.
He says, "Quite a few people in the world have seen my penis. So that’s kinda cool."
