WILL SMITH and JAY-Z are facing legal action over their hit Broadway musi cal FELA! - a New York photographer has filed suit alleging one of her pi ctures was used in the production without her permission.
The Tony Award-winning show, which is co-produced by the stars, tells t he story of late Afrobeat legend Fela Kuti and features an iconic picture of the singer’s Nigerian nightclub as a backdrop.
Marilyn Nance, the snapper who took the 1977 photo of the Africa Shrine venue, is suing the show’s producers for $150,000 (=C2=A3100,00) allegin g they used the picture without her consent.
In the legal papers, Nance’s lawyer Edward Greenberg writes, "You have employed our client’s registered image without her permission, license or consent." The suit also claims the image has been used on souvenir books, the sho w’s soundtrack CD and in a music video.
A publicist for the production, Richard Kornberg, has acknowledged the legal action and insisted Nance should have notified the producers of the problem sooner.
He tells the New York Daily News, "We tried to resolve the claim but co uld not, and are now in the process of replacing that image. Unfortunatel y, this photographer waited two years to voice an objection to our use of this image. Had she notified us earlier, we would’ve replaced it then."

R&B star CIARA almost lost out on the chance to chat with MICHAEL JACKSON after she missed the King of Pop’s call.
Jackson had approached the singer about appearing on a planned charity record to benefit the victims of 2005’s Hurricane Katrina - and she was s tunned to receive a personal call from the Thriller hitmaker.
But the memorable chat almost didn’t happen - because the Goodies star didn’t have her cell phone with her when the late Thriller legend got in touch.
She tells Britain’s OK! magazine, "I didn’t get to meet Michael Jackson but I did get to talk to him on the phone. It was cool and really surrea l because I love Michael.
"I did actually (know he was going to call). I knew he was going to rea ch out to me and it’s funny because I missed his first phone call.

FOXY BROWN’s manager has denied the rapper was dropped by her lawyer just before a court appearance on Tuesday (27Jul10) - insisting the hip-hop s tar decided to go with a more "high powered" attorney.
The Candy star, real name Inga Marchand, was arrested in Brooklyn last week (21Jul10) following a reported confrontation with a neighbour, who c laimed Brown cursed at her and bared her bottom in a heated dispute.
Brown was charged with public lewdness, harassment and criminal contemp t. She pleaded not guilty when she was arraigned in Brooklyn Supreme Cour t on Thursday (22Jul10).
And Marchand was dealt another blow before a hearing on Tuesday when sh e lost her lawyer from Bruce Barron Associates.
The New York Post reported that the legal firm had dropped its embattle d client, but the rapper’s manager, Bernadette Brennan, tells AllHipHop.c om that the star had "decided to go with a high power attorney".
However her new lawyer, Salvatore Strazzullo, couldn’t prevent the pres iding New York judge from extending a protective order, which requires Ma rchand to keep her distance from her neighbour Arlene Raymond, according to the New York Post.

Former U.S. Vice President AL GORE was questioned by cops last week (ends 26Jul10) in relation to allegations he groped a masseuse in 2006, accordi ng to U.S. reports.
Officers in Portland, Oregon announced last month (Jun10) they are reop ening an investigation into claims Gore inappropriately touched masseuse Molly Hagerty during a massage session at a hotel in October 2006.
Hagerty reportedly gave a police statement in 2009, but authorities wer e said to have dropped the investigation at the time due to "insufficient evidence to support the allegations".
A rep for Gore vehemently denied the allegations, insisting that a new investigation "will only benefit Mr. Gore".
And according to Oregon network KATU, detectives quizzed the politician -turned-environmentalist in San Francisco, California last Thursday (22Ju l10).

Former child star LANCE KERWIN has been found guilty of second-degree the ft and placed on five years probation in Kauai, Hawaii.
The actor, who played the lead role on 1970s U.S. TV show James at 15, was ordered to carry out 300 hours of community service and was given cre dit for time already served during sentencing last week (22Jul10).
Kerwin, who quit acting to become a pastor, was found guilty of faking documents to get state medical assistance and free food stamps - despite owning three homes.
He has repaid $21,822 (=C2=A314,000).
When sentenced to community service and placed on probation, he said, " I’m sorry. The last thing I want to do is to make a statement to minimise what I have done."

JUNO screenwriter DIABLO CODY has given birth to a baby boy.
Cody, who won an Oscar for writing the 2007 comedy about a pregnant tee n, announced her own impending birth in April (10) via Twitter.com.

American/Canadian actor MAURY CHAYKIN has died on his 61st birthday.
The rotund character actor, best known for his role in Entourage, died in Toronto, Canada on Tuesday (27Jul10). He was believed to have been bat tling a kidney ailment.
Appearing in dozens of movies and TV shows since beginning his career i n 1975, Chaykin became recognisable for his larger-than-life characters, appearing in Dances With Wolves, My Cousin Vinny, The Mask of Zorro and A Life Less Ordinary.
He found new fame playing Harvey Weingard - a parody of producer Harvey Weinstein - in hit TV show Entourage between 2005 and 2007.
Chaykin is survived by his actress wife Susannah Hoffmann and a daughte r, Rose.

LINDSAY LOHAN is "upset" after learning she may not have time with her fa mily before heading to court-ordered rehab following her release from pri son, according to her lawyer.
The Mean Girls actress was sentenced to 90 days behind bars for breachi ng her parole in relation to a 2007 DUI arrest and she was admitted to th e Century Regional Detention Facility in Lynwood, California, earlier thi s month (Jul10).
At the time of her sentencing she was ordered to start a three-month st int in a rehabilitation centre as part of her probation no later than 24 hours after she completed her jail time.
And the star’s lawyer Shawn Chapman Holley admits her celebrity client is emotional after learning she may not have a chance to spend time with her mother and siblings before she enters the clinic.
Holley tells People.com, "She’s a little upset right now… She’d like to spend some time with her family, and there’s at least some question as to whether or not she’ll have to go directly to rehab.
"There’s a push now for her to go directly to rehab from jail. I think it would only be fair for her to spend some time with her family and that ’s what she’d like for me to emphasise to (the) judge." Lohan is expected to be released as early as next week (begs02Aug10) - two weeks after she started her sentence.

MADONNA’s charitable foundation has shot down reports the pop star is org anising a huge Live Aid-style concert to raise funds for Malawi.
The Material Girl superstar has poured money into the country over the last few years through her Raising Malawi organisation and she is current ly building a girls school outside the capital Lilongwe.
It was reported earlier this month (Jul10) that the singer was organisi ng a huge charity gig in the impoverished nation - from where her two ado pted children, David and Mercy, hail.
She had allegedly asked U2 star Bono to headline the concert, which was said to be taking place in September (10).
But the foundation’s website has branded the reports "entirely false".
A statement on the site reads, "This past weekend, reports circulated r egarding a Raising Malawi benefit concert in Blantyre, Malawi. These repo rts are entirely false; Raising Malawi and Madonna have no plans to host such an event."
