HARASSMENT CASE AGAINST LOHAN’S EX DISMISSED

A harassment case against MICHAEL LOHAN’s ex-fiancee ERIN MULLER has been= dismissed, following the showbiz dad’s accusations she kicked him in the= head during a heated argument.
Lindsay Lohan’s father has recently been locked in a legal battle Mulle= r, which has seen both parties arrested on separate occasions.
The outspoken patriarch claimed his ex was too "drunk and high" to driv= e during an incident in November (09) - triggering an argument outside hi= s mother’s New York home.
Lohan alleged Muller intentionally kicked him in the head when he opene= d her car door to try and stop her from getting behind the wheel.
Muller turned herself into police on 17 December (09) and faced a charg= e of harassment in the second degree - days after she alleged Lohan had v= iolated a restraining order by calling her.
According to TMZ.com, New York’s Nassau County Court dismissed the crim= inal case against Muller on Wednesday morning (20Jan10).
Lohan’s restraining order against Muller was unaffected by the ruling.
Muller has also filed papers accusing Michael of abusing her over a doz= en times between 2007 and 2008. He has denied her allegations. (JMA/WNWCZ=

GIBSON’S FRANTIC DRUGSTORE DASH TO SAVE DAUGHTER

MEL GIBSON has come clean about another past infraction - he once inadver= tently attacked an old lady and an injured man in an Australian drugstore= ..
The actor admits he "wrecked the place" in Coogee, near Sydney as he da= shed from the pay kiosk to the door in an effort to stop his 21-month-old= daughter walking into traffic outside.
The incident took place 27 years ago, but Gibson still shudders as he r= ecalls the moment he realised just how far he’d go to protect his kids.
The Braveheart star tells WENN, "I went to the pharmacy to buy some for= mula for my newly-born twins; they’re now 27. I brought my 21 month old t= o the pharmacy with me because my wife was at home occupied with twins.
"We had a nurse from New Zealand at the time who used to help out durin= g the day. We’re in the pharmacy and I’m buying formula and I take my eye= s off the child for a second and the next thing I look up and I see my ch= ild standing about 25 yards away on the edge of a curb and the nurse is a= t a bus stop on the other side with traffic blowing in front of her.
"My daughter is trying to go over to her and say ‘Hi.’ I’m thinking, ‘O= K, 25 yards and not much time to get the kid.’ "So, needless to say, there was a man with broken ribs and and an old l= ady with a footprint on her face because I completely wrecked the place t= o get to the kid. I broke everything and ran through things and lifted th= ings and threw things out of the way to pluck her out before she got stru= ck by a car.
"I had to apologise to all those people afterwards and they didn’t unde= rstand. They get very angry, of course, because I knocked an old lady ove= r."

SHEEN ASKS JUDGE TO RELAX RESTRAINING ORDER TO TEND TO ILL WIFE

CHARLIE SHEEN’s lawyers have asked the judge overseeing their client’s as= sault case to modify an order preventing him from communicating with his = ill wife while she is in hospital.
Brooke Mueller underwent emergency surgery on her wisdom teeth earlier = this week (18Jan10) and was hospitalised when an infection set in. She wa= s admitted on Wednesday (20Jan10), reportedly suffering from a bout of pn= eumonia.
Sheen has attempted to gain access to his wife in hospital - but he was= refused access due to a restraining order stemming from a Christmas Day = (25Dec10) bust-up between the actor and his wife.
Sheen was charged of assault, menacing and criminal mischief, and jaile= d.
Following his hospital visit, the actor’s legal team asked the judge ov= erseeing the case in Aspen, Colorado to change the rules of the protectiv= e order, so that he could tend to his ill wife.
In legal papers obtained by TMZ.com, Sheen’s lawyer, Richard Cummins, t= old the judge that the actor "is concerned and feels the necessity to ass= ist and care for his wife." Following his visit to the hospital, Sheen told awaiting reporters that= Mueller is "fine" following treatment in the facility’s intensive care u= nit and has responded well to antibiotics.
The two are due to appear in court in Colorado on Friday (22Jan10) for = a hearing about their Christmas Day fight and ongoing restraining order c= oncerns.
Meanwhile, Mueller’s lawyer has confirmed his client is suffering from = an infection caused by oral surgery.
Yale Galanter claims the real estate agent developed a fever following = surgery.

AFFLECK IS DESPERATE FOR A SON

BEN AFFLECK is begging wife JENNIFER GARNER to get pregnant one more time= and give him the son he’s desperate for.
The couple have two daughters, Violet, four, and 12-month-old Seraphina= , and Affleck is keen for a baby boy to complete the trio.
But Garner is reluctant to abandon the pre-pregnancy figure she worked = so hard to achieve.
The actress tells Us Weekly, "Ben would like a boy, but I don’t want an= other baby right now." And Garner’s friends are on her side, one pal telling the star, "You do= n’t want to do that all over again. You worked hard to get your body back= .."

Rage Against The Machine star Morello will appear on the title track of= Rise Up and another tune when the new release hits stores in April (10).

VAMPIRE WEEKEND SINK THEIR TEETH INTO THE TOP OF THE U.S. ALBUM CHARTS

Cult act VAMPIRE WEEKEND have scored their first U.S. number one album af= ter ending seven weeks of girl power at the top of the Billboard 200.
Susan Boyle and Ke$ha ruled the end-of-the-year and early 2010 charts, = but the New York band have taken over, thanks to debut-week sales of 124,= 000.
Boyle’s I Dreamed a Dream holds at number two, while Ke$ha’s Animal fal= ls to three, Lady GaGa’s The Fame drops to four and The Element of Freedo= m by Alicia Keys rounds out the new top five.
Lady GaGa enjoys double success in the top 10 - her Fame Monster album = jumps up from 10 to six.

JEAN DESPERATE FOR NEWS FROM COLLAPSED ARTS CENTRE

WYCLEF JEAN is desperate for good news about the arts school his Yele fou= ndation built in his native Haiti - because the entire site was crushed b= y an earthquake last week (12Jan10) and he fears all the students and tea= chers are dead.
The Yele Center was less than a year old when it collapsed during the 7= ..0-magnitude earthquake, which shook Haiti, and Jean, who visited his hom= eland at the weekend, admits he fears the worst.
He says, "As of now… everyone passed away.
"The idea of a school collapsing… and every kid in the school, includ= ing the teachers, just completely wiped out is unheard of." The school was responsible for a special line of T-shirts, sold in Timb= erland stores across America.
Jean explains, "These artists did these incredible T-shirts that were i= n Timberland stores all around the world. It was Haiti on a Timberland T-= shirt."

WYCLEF FIGHTS BACK TEARS AS HE DESCRIBES HAITI HORRORS

Hip-hop star WYCLEF JEAN fought back tears on U.S. TV talk show OPRAH on = Wednesday (20Jan10) as he recalled the horror he experienced during a rec= ent return to his earthquake-ravaged homeland Haiti.
The former Fugees star, his wife and a cousin shot Flip phone footage o= f their visit to Port-au-Prince following last week’s (12Jan10) 7.0-magni= tude earthquake, as they helped locals collect and bury the dead.
Jean said, "There’s what you see by the airport and there’s inside the = belly of the beast… The entire city feels like a morgue and, for every = two blocks (there are) 15, 16 bodies on the floor, no plastic on them; th= ree of them are children. (There’s) people running through the city holdi= ng their baby in their hands, while the baby’s dead.
"The aid workers can’t do much because there are so many people; they’r= e out of medicine at times." Jean aired the harrowing footage his cousin Jerry shot. It showed the h= itmaker and members of his family taking part in a desperate relief effor= t.
On film, he said, "Everywhere we walked, bodies are abandoned in the st= reet… We spent hours in the heat, piling up the bodies. The smell is ov= erwhelming… The local cemeteries are already overflowing so these survi= vors are digging shallow graves for the dead. Most of these people laid t= o rest here will never be identified." The film also showed Jean trying to find a hospital bed for a 14-year-o= ld girl who had been trapped beneath her home for days - only to discover= the city’s hospital had been reduced to rubble in the quake.
But it was the little hope he witnessed among his fellow Haitians that = had Jean holding back tears.
He added, "The people were singing, despite what they were going throug= h… We know what struggle is.
"It’s will, it’s determination… the only thing we have that we can ho= ld on to is our pride." Earlier in the week (beg18Jan10), Wyclef urged relief officials and U.S= .. soldiers to evacuate Port-au-Prince completely, so the dead could be bu= ried.

ANDREWS: ‘I WON’T BE SINGING IN LONDON’

JULIE ANDREWS has ruled out a singing comeback in 2010, insisting reports= she’ll be belting out classics from her films and Broadway shows have be= en exaggerated.
The Mary Poppins and The Sound of Music star doesn’t want British fans = expecting her to perform songs like Do-Re-Mi and A Spoonful of Sugar when= she performs in London this May (10) - an illness earlier this century c= ost her her voice, and she fears she’ll never get it back.
Andrews tells WENN the show at the 02 Arena will be similar to one she = toured America with last year (09) - which was more a tribute to songwrit= ers Rodgers & Hammerstein, and featured Andrews narrating her way through= the songs the duo wrote for her, showing clips from her films.
The actress says, "I am not singing. It just so happens that there was = this erroneous announcement that I was having vocal restoration, which co= incided with the announcement of the concert, which was really unfortunat= e.
"I haven’t had vocal rejuvenation or anything like that. I did five con= certs last year. It’s a gorgeous evening of music. I do participate in th= e five deep base notes that I have. I do sing/speak a lot. I narrate, I t= ell stories and I host.
"I go right out and say, ‘You all know I have had vocal surgery and I d= o have about five bass notes left, so I can assure you I can still sing t= he hell out of Old Man River."

CAMERON HONOURED BY PETA

Moviemaker JAMES CAMERON has landed another honour - for his portrayal of= aliens in AVATAR.
Animal rights group PETA has handed the director a Proggy Award for Out= standing Feature Film for "the inspiring message in his blockbuster".
A PETA spokeswoman says, "Viewers will recognise how the plight of Avat= ar’s catlike Na’vi people, who are faced with being driven off their land= by a greedy corporation, closely echoes the real-life plight of animals = on earth, many of whom continue to be torn away from their homes and fami= lies and locked up in cages in zoos, circuses, and laboratories.
"PETA also applauds the movie’s stunning special effects, which beautif= ully illustrate how unnecessary it is to subject animals to the stress of= a film production." The group’s Senior Vice President Lisa Lange adds, "We hope viewers wil= l come away from Avatar with a new way of looking at the world around the= m and the way we treat our fellow earthlings.
"For helping animals with the positive message of this film, James Came= ron is PETA’s ‘King of the World.’"

MUELLER HOSPITALISED FOR SUSPECTED PNEUMONIA=20

CHARLIE SHEEN’s estranged wife BROOKE MUELLER was admitted to a Californi= a hospital on Wednesday (20Jan10), suffering a fever and suspected pneumo= nia - according to online reports.
Mueller checked herself into a medical centre in Sherman Oaks after her= temperature soared to a dangerous 105 degrees fahrenheit, TMZ.com report= s.
Shortly after being admitted Sheen paid his spouse a visit, despite a r= estraining order banning him from having any direct contact with her.
The medical emergency comes just two days before the couple are due in = court to dispute the order.
Their bust-up stems from Sheen’s arrest on Christmas morning (25Dec09) = after a nasty dispute with Mueller in Aspen, Colorado.
He faces charges for second-degree assault, menacing and criminal misch= ief for the incident, after allegedly threatening Mueller with a knife.
The Two and Half Men actor faces up to eight years for the menacing cha= rge, the most serious of the three, in addition to a fine of between $2,0= 00 (=C2=A31,250) and $500,000 (=C2=A3312,500).

TARANTINO’S BASTERD DEAL TO CHOKE KRUGER

DIANE KRUGER put her life in the hands of director QUENTIN TARANTINO on t= he set of war movie INGLOURIOUS BASTERDS - after agreeing to let the film= maker choke her during a fight scene.
Kruger plays German spy Bridget von Hammersmark in the film about a gro= up of Jewish-American Nazi killers.
In one brutal scene Kruger’s character is strangled - and Tarantino was= convinced the only way to make the struggle realistic was to choke his l= eading lady himself.
He explains, "When you watch the film those are actually my hands that = are on Diane Kruger’s throat strangling her. I made a deal with her early= on. (I told her) ‘We’re gonna have to choke you if it’s gonna actually w= ork and I don’t trust anybody but myself to do it.’ And she didn’t trust = anybody but me to do it … so she was down (ok) with it but I remember t= alking to her about it (and saying) it’s going to be a little uncomfortab= le."

MURPHY FEARED SHE’D DIE YOUNG

Tragic actress BRITTANY MURPHY feared her heart condition would kill her = young, her widower has revealed.
Murphy was born with mitral valve prolapse, which prevented one of the = valves in her heart from closing properly.
The condition is manageable and doctors saw no reason why Murphy should= not lead a normal life - but her husband Simon Monjack claims the illnes= s haunted the star.
He tells People magazine, "She had expressed to me a fear of dying youn= g and a fear of her heart. We had it checked out every way you could imag= ine." Murphy died on 20 December (09) after suffering a cardiac arrest, aged = just 32. The cause of her death has been deferred pending toxicology test= results.

DAY ADMITS DRINK DRIVING CHARGE

British actor/singer DARREN DAY has pleaded guilty to a charge of drink d= riving.
The star smashed his sportscar into a lamp-post in Edinburgh, Scotland = last month (Dec09) and was subsequently accused of stepping behind the wh= eel while intoxicated He appeared at Edinburgh Sheriff Court on Wednesday (20Jan10) and enter= ed a guilty plea to a charge of driving while over the legal alcohol limi= t. He also admitted a charge of failing to stop to give his name and addr= ess after a traffic accident.
However, he entered a not guilty plea to three other charges - driving = without due care and attention, failure to report an accident and failure= to co-operate with a preliminary breath test.
Day will be sentenced for the drink-driving offence next month (10Feb10= ), when he also faces a hearing for a further charge of possession of a w= eapon, after cops allegedly found him with a kubotan, a self-defence weap= on usually kept on a key-chain.
In the mean time he has been banned from holding or obtaining a driving= license.
The drink-drive arrest came just over a year after Day was handed a dri= ving ban in August 2008 after pleading guilty to drink-driving charges fo= llowing an arrest in Wales.

IOMMI PUTS PEN TO PAPER

BLACK SABBATH rocker TONY IOMMI is documenting his life in the hellraisin= g band in a new autobiography.
The book, Iron Man, is due to be published later this year (10), after = U.S.-based Foundry Literary & Media bought the publishing rights for a si= x-figure sum at auction.
Announcing the deal, Foundry boss Peter McGuigan described Iommi’s tome= as "Angela’s Ashes meets The Ground Beneath Her Feet meets Spinal Tap".
The memoir will follow the 2009 release of former bandmate Ozzy Osbourn= e’s own autobiography.
The two men are currently embroiled in a legal battle over the Black Sa= bbath name. In May last year (09), Osbourne filed suit in a federal court= in New York against Iommi alleging he illegally claimed the band name. I= ommi claims his bandmates relinquished their rights to the name back in t= he 1980s - and is seeking an equal split between all the original bandmem= bers.
