HULK HOGAN’s son NICK will return to court next year (10) to face a negligence lawsuit filed by the family of the friend he left brain damaged when he crashed his car in August 2007.
Nick Bollea was freed from Florida’s Pinellas County Jail in October (08) after serving 166 days of an eight month prison sentence for his part in the high speed collision that left John Graziano with permanent brain injuries.
Graziano’s family filed an auto negligence civil lawsuit against Nick, his wrestler dad Hogan, real name Terry Bollea, his mother Linda Bollea and friend Daniel Jacob in March (09), alleging they were negligent in the acts leading up to Graziano’s injury.
The family is seeking unspecified damages in the suit.
Pinellas-Pasco Circuit Judge W. Douglas Baird ruled on Monday (13Apr09) he will clear three weeks from his calendar in March 2010 to preside over the trial if the parties are unable to settle the case before that date.

American gymnast-turned-reality TV star SHAWN JOHNSON has been granted a three year restraining order against a man who attempted to break onto the set of DANCING WITH THE STARS to meet her.
A Los Angeles County Superior Court judge ordered Robert O’Ryan to stay at least 100 yards away from 17-year-old Johnson and her parents for the next three years on Tuesday (14Apr09), reports TMZ.com.
O’Ryan, 34, was allegedly caught by security last month (23Mar09) as he tried to hurdle a fence at the show’s studios in Los Angeles.
A police search of his car discovered a shotgun and a handgun, as well as duct tape and love letters written to Johnson.
He pleaded not guilty last month (Mar09) to one felony count of stalking and two misdemeanour counts of carrying a loaded firearm in a vehicle, and is being held on $220,000 (£150,685) bail until his trial date on 27 April (09).
If convicted, O’Ryan faces up to four years in a state prison.

JAMIE FOXX almost walked away from his new movie about a schizophrenic musician, because the role was so gruelling it left him needing therapy.
The Oscar winner struggled to make the transition from his real personality to that of homeless cello prodigy Nathanial Ayers in The Soloist - and he admits the role pushed him to his limit.
Foxx says, "It was something that I enjoyed, but it shredded me. I went to places that I never thought I would ever go. I just remember being in my bathroom broke (sic) down, talking to my manager like, ‘I don’t know if I’ll be able to finish this.’ "You had to lose your mind every day you’re on set, and sometimes you didnâ��t have enough time to get your mind back before the weekend." Foxx’s manager was so concerned, he even sent the star to a psychiatrist.
The actor adds, "(He told me), ‘Just so you’ll have a way to get out of your head.’" And Foxx now regularly uses a therapist during movie projects, explaining, "I had no idea that the mind could be that fragile."

An Austrian woman who sent a death threat to CSI: MIAMI star DAVID CARUSO after failing to get his autograph was jailed for seven months on Tuesday (14Apr09).
The unnamed 41-year-old was accused of sending approximately 100 letters to Caruso, including one in which she threatened his life.
She fled to Mexico in attempt to avoid arrest, but gave herself up to Austrian authorities in March (09) after 10 months on the run.
A court in Innsbruck, western Austria has ordered the woman to be held in a centre that treats prisoners with psychiatric problems.
Her lawyer has reportedly not ruled out an appeal.

NICOLLETTE SHERIDAN was axed from DESPERATE HOUSEWIVES to save money, show creator MARC CHERRY has revealed.
The actress’ man-eating character Edie Britt bows out of the hit show on Sunday night (19Apr09), in a bizarre car crash that leaves her presumed dead.
Her departure comes amid rumours she was forced out because of a rift with her castmates.
But Cherry insists he was forced by network bosses at ABC to cut costs, and the axe fell on Sheridan’s head because her character had run its course.
He tells TV Guide magazine, â��Edieâ��s already slept with most of the guys on the street and has caused about as many problems as she could. There has been tremendous pressure put on me to cut costsâ�¦the network is saying to all the shows, â��The company is really hurting financially. You must find a way to produce these shows more cheaply.’â�� But Sheridan, who was paid between $100,000 (£67,000) and $200,000 (£134,000) per episode during her stint on the show, accuses Cherry of wasting her character.
She says, �When you have a jewel, why not polish it and put it out there for all to see?" And she warns axing her may backfire for Cherry: �(Killing off Edie) was a risky decision that could have devastating ramifications."

TRANSFORMERS star SHIA LABEOUF has revealed the full extent of the hand injury he suffered in a car crash last summer (08) - it will never heal 100 per cent.
Nearly nine months after he flipped his Ford truck over during an early morning car accident, LaBeouf admits the damage done to his left hand still hasn’t healed - and he tells Entertainment Weekly magazine it probably never will.
His hand was so badly crushed that one finger had no bone left in it, and he has been told he’ll only get back "about 80-something per cent" of his left hand’s dexterity.
In an exclusive interview with the upcoming publication, the young actor says, "I’ve had screws and plates put in. They put a screw in one of my knuckles. And they shaved a piece of bone off my hip and made a finger out of it.
"I’m on my third surgery. That’s coming up… My middle finger is still crooked as a f**king noodle, so they’ve gotta straighten it out and put a screw in it." But, no matter how well the surgery goes, LaBeouf will always be left with a permanent reminder of the crash - and how close he came to losing the use of his left hand.
He explains, "I’ll be able to make a fist again (but) there’s a knuckle I’ll never be able to move again."

Spanish beauty PENELOPE CRUZ has vowed to steer clear of cosmetic surgery to maintain her youthful looks, insisting she aspires to grow old gracefully like her icon SOPHIA LOREN.
The Vicky Cristina Barcelona actress, 34, admits she welcomes the idea of ageing and has no qualms about the thought of grey hair and wrinkles.
She tells Britain’s Cosmopolitan magazine, "Age holds absolutely no fear for me. There is so much enjoyment ahead.
"Sophia is 74 and amazing - every time I talk to her, she’s full of wonderful stories about old actors." But Cruz confesses that despite regularly being named one of the most beautiful women in the world, she is still not completely content with her body.
She adds, "I know myself a little bit more (as I grow older)… but I wish I was less insecure. I’ve always had my insecurities and most of them have not gone away. I guess we’re all vulnerable."

JONATHAN RHYS MEYERS will end his reign as HENRY VIII on TV series THE TUDORS next year (10) - U.S. network bosses have picked up the show for its fourth and final season.
Showtime network executives have decided to air Meyers’ last scenes as the 16th century English monarch next spring (10).
The final 10 episodes will follow the monarch’s tumultuous relationships with his last two wives: Catherine Howard, who was beheaded for treason, and Katherine Parr, who outlived the king, reports the New York Post.
Production is scheduled to begin this June (09) in Dublin, Ireland.

MADONNA is defying the effects of the global recession - she has reportedly splashed out $40 million (£22.7 million) on a new home in New York’s posh Upper East Side.
The superstar has signed a contract to buy a four-story Georgian-style townhouse for $5 million (£3.4 million) less than the original asking price, reports the New York Post.
The mansion features 13 bedrooms and 14 bathrooms, a two-car garage, a 3,000-square-foot garden, nine fireplaces, an elevator and a wine cellar with a grotto.
But the lavish house is not yet ready for the Material Girl singer to move in - she’s reportedly planning extensive renovations, including security upgrades on the property.
London-based Madonna has been rumoured to be considering returning to New York full-time ever since she finalised her divorce from British director Guy Ritchie in January (09). The couple share eight-year-old son Rocco, and three-year-old adopted Malawian son David Banda. The singer also has daughter Lourdes, 12, from a previous relationship.

LINDSAY LOHAN has poked fun at her wildchild reputation and split from girlfriend SAMANTHA RONSON in a spoof dating advert for WILL FERRELL’s comedy website FunnyOrDie.com.
The Mean Girls star is a regular in the tabloids and gossip columns, thanks to a tumultuous personal life, a string of drink driving arrests and three stints in rehab in recent years.
But Lohan has turned the extra attention into material for the funny skit, in which she laughs off rumours DJ Ronson’s family is seeking to file a restraining order against her and claims she is on the verge of bankruptcy.
In the spoof, Lohan says, "Hi, my name’s Lindsay and I’m searching for love. I’m recently single, I think, and I’m looking for someone I can spend the rest of my life with - or, at least, the rest of my probation with.
"A little bit about me… I’m an actress, a singer, an entrepreneur, and I have single-handedly kept 90 per cent of all gossip sites in business. Guitarist ROCKY HILL has passed away, at the age of 64.
Hill - the brother of ZZ Top star Dusty Hill - died of �undisclosed complications of a medical condition" at his home in Houston, Texas on Friday (10Apr09), according to a statement released by his family.
He had started his career in the late 1960s as part of psychedelic rock band American Blues with his brother. He then went on to forge a relatively successful career as a guitarist while Dusty found huge fame as part of legendary rockers ZZ Top.
Hill is survived by his wife Joy Darlene Smith and a son.

Rapper N.O.R.E. is celebrating a new addition to his family - his girlfriend has given birth to a baby boy.
The Nothin’ hitmaker, one half of hip-hop duo Capone-N-Noreaga, broke the happy news on his Twitter.com page on Thursday (09Apr09).
Writing on the social networking website, he said, "It’s a boyeeeee!! (sic)", before following up that post with another on Friday morning (10Apr09): "Had a baby boyee (sic) yesterday!!! The NORE n**ga happy!!!" But Miami, Florida-based N.O.R.E., real name Victor Santiago Jr., also confessed he was so shocked to learn his unnamed partner had gone into labour, he almost fainted before he’d even reached the hospital delivery room.
He adds, "I heard of fainting in (the) emergency room; I was gonna faint in the crib (home) though, s**t."

RUN-DMC star JOSEPH SIMMONS’ daughter ANGELA has shot down reports she’s dating rapper BOW WOW after he declared the fashion designer "the love of (his) life".
The 21-year-old, who runs the fashion line Pastry with her sister Vanessa, has been romantically linked to the Like You hitmaker for the past year, and Bow Wow appeared to confirm rumours of a relationship in the latest issue of Giant magazine.
He told the publication, "Angela Simmons is the love of my life. She’s a young black woman doing something incredible. She’s a CEO of a company at 21 years old and a positive role model for kids." But Simmons is mystified by Atlanta, Georgia resident Bow Wow’s comments, because she’s happily involved with someone else.
Addressing the reports on GlobalGrind.com, she writes, "I just want to shut down any and all rumours about my relationships, because you know how that can get.
"I am currently in the happiest relationship I have ever been in, and MY other half lives in Texas."

Rap superstar LIL WAYNE has been accused of attempting to dodge a copyright infringement lawsuit over his track MRS. OFFICER.
The Lollipop hitmaker is being sued by producer Michael ‘Mali Boy’ Bradford, who alleges the song bears strong similarities to a tune called Crush, which he composed for a little-known artist named Sky.
Bradford claims the track somehow ended up in the hands of beatmaker Deezel, who turned it into Mrs. Officer for the rapper’s Grammy-winning 2008 album, Tha Carter III.
He filed suit in January (09) in a Georgia court - but Bradford’s lawyers have been unable to serve the star’s attorney with the court summons, and is accusing them of deliberately keeping a low profile to avoid the case.
A statement released by Bradford’s representative says, "It (the case) is currently awaiting a responsive answer from the defendants. According to the plaintiff Michael Bradford, Lil Wayne’s attorney, Mr. Sweeney has attempted to evade the summons in order to answer the complaint. Deezel has filed for two thirty (30) day extensions to file an answer, the other defendants in the case were given a sixty (60) day waiver of summons." However, Bradford has had some success in his bid to win a share of the royalties from the song - executives at Wayne’s label, Cash Money Records, have agreed to temporarily halt payments from Mrs. Officer.
The statement continues: "Cash Money Records has agreed to put a freeze on mechanical royalties payments for all retail, digital downloads and ringtone product sales until the civil matter involving Mrs. Officer is resolved." Mrs. Officer isn’t the only song Lil Wayne, real name Dwayne Carter, Jr., has had legal problems with - he is also fighting allegations he illegally sampled songwriter Karma-Ann Swanepoel’s Once in his track I Feel Like Dying.

SEX AND THE CITY: THE MOVIE actor GILLES MARINI is putting off surgery to fix his injured shoulder so he can continue to battle it out for the DANCING WITH THE STARS winners’ title.
The sexy star was hurt in February (09) while rehearsing for the U.S. TV show, joining fellow contestants Steve-O, Jewel and Denise Richards among the competition’s walking wounded.
But Marini has vowed to press on with the vigorous dance routines in the hope of winning the show - and he credits his professional partner Cheryl Burke with helping him get around his separated shoulder.
He tells People.com, "I used only my right arm (for the jive). She makes sure I only do what I can do. I didn’t use my left arm. I need surgery because the bones (in the left shoulder) have separated. So after the show I will get surgery and that will take a day and about three weeks to recover and I’ll move on with life."

Oscar winner MARLEE MATLIN is urging victims of domestic violence to leave their partners - insisting her allegedly abusive affair with WILLIAM HURT was "not worth it".
The 43-year-old deaf actress was only 19 when she began a two-year affair with 35-year-old actor Hurt - which she claims ended when it became physically abusive.
Matlin refuses to speak ill of Hurt, and credits him with helping her seek help for her alcoholism - but she has vowed to rally for abused women in the hope they’ll escape a life of being battered and bruised at the hands of their partners.
She says, "It’s absolutely not worth the life that you lead… There is a world out there that’s better than where you are right now. Just open that doorknob and walk out. Singer AMY WINEHOUSE has reportedly penned a new track called THE ULTIMATE BETRAYAL following claims her estranged husband is expecting a child with another woman.
Mother-of-two Gilleen Morris told a British newspaper at the weekend (11-12Apr09) that she is six weeks pregnant with Blake Fielder-Civil’s baby.
Winehouse was reportedly heartbroken by the news - and has written an emotional song about her turbulent relationship with Fielder-Civil while working on a new album in St. Lucia, according to British newspaper The Sun.
A source tells the publication, "Amy still felt they had something between them and that one day they’d be together again. But this news destroyed her. She sat down with her guitar and started writing The Ultimate Betrayal. She keeps repeating the line: Blake a baby, no, no, no. It’s very haunting.â��

BOYZONE star RONAN KEATING is planning to avoid MICHAEL JACKSON’s comeback concerts - insisting the pop superstar is a shadow of his former self.
Jackson is making a return to the stage in July (09) with his 50-date This Is It run at London’s O2 Arena.
But despite a huge demand from the public to see the Thriller hitmaker in action, Keating is adamant he will not be attending any of the shows.
He says, "I don’t want to go and be disappointed. I love Michael - but when I see him in the papers he is on crutches or in a wheelchair. I want to see him do all the moves. I don’t want to see someone who used to be Michael Jackson."
