CHRISTIAN BALE’s eagerly anticipated TERMINATOR SALVATION movie has been thrown into turmoil after its three main producers became embroiled in a $160 million (£114 million) lawsuit.
Moritz Borman filed suit against his fellow producers Derek Anderson and Victor Kubicek at Los Angeles Superior Court on Friday (06Mar09), accusing the pair of fraud and breach of contract.
Borman claims he help arrange for Anderson and Kubicek to acquire the rights to the Terminator franchise for their company Halcyon Co. in 2007.
It gave the pair full rights over the production of Terminator Salvation and any future sequels, plus merchandise and licensing.
Borman alleges financial backing for the movie was secured through investment fund Pacificor LLC in exchange for approval rights over the movie, involvement in all creative decisions, and a $5 million (£3.4 million) producing fee.
However, in the lawsuit, he claims the pair failed to honour their initial agreement, "hijacking" the production in July 2008 and refusing to pay him the $2.5 million (£1.7 million) fee he was due.
The legal document reads, "Notwithstanding the fact that defendants obtained the substantial franchise rights and assets through Borman, Anderson and Kubicek failed to honor their assurances, representations and contractual obligations to Borman. Defendants’ egregious fraud, bad faith conduct and refusal to abide by their contracts has led to the filing of this lawsuit.
"It also came to light that Anderson and Kubicek did not have the means to finance the picture, had defaulted on numerous loans and owed over $1 million to creditors on the picture." Now, Borman is seeking $160 million (£114 million) in damages through the L.A. courts.

HEATH LEDGER’s Oscar will be with his daughter MATILDA later this month (Mar09), according to Academy Awards bosses.
The late actor’s parents and sister stepped up to accept his posthumous honour at the Oscars on 22 February (09), and they told reporters they’d be keeping the Best Supporting Actor prize for some time.
But website GoldDerby.com has revealed Ledger’s folks have had a change of heart - and they plan to honour an agreement they made with Academy executives.
The deal suggests Matilda’s mother, actress Michelle Williams, will look after her ex-lover’s Oscar until her three-year-old daughter turns 18.
Academy spokesperson Leslie Unger tells GoldDerby.com, "We expect a representative of the Ledger estate to bring the statuette in so that the engraved plate can be affixed. Soon after that, we expect the statuette to be delivered to Michelle Williams." The website reveals Ledger’s other posthumous acting awards, including his Golden Globe, were sent to the office of his publicist, Mara Buxbaum, who also represents Williams.
As WENN went to press there was no confirmation about what would become of these honours, but Buxbaum has confirmed that agreements made with Oscars bosses and others have been honoured.
She tells WENN, "I can certainly say that guidelines from the Academy or any other organisation have been happily accepted and followed."

RIHANNA’s lawyer and CHRIS BROWN’s publicist are playing down reports the R&B couple is planning a book deal together in a bid to rehab the disgraced Kiss Kiss singer’s image.
On Thursday (05Mar09), Chicago Sun-Times columnist Bill Zwecker claimed Brown’s management team was working on a deal with Rihanna’s handlers, which would include a joint book project, a series of TV interviews together and a whopping $10 million (GBP7.1 million) hand-out to the Umbrella singer if Brown ever made a repeat performance of his alleged 8 February (09) beat down, which left the pretty pop star in hospital.
A source told Zwecker, Brown would pay "as much as $10 million… if he as much as squeezes her arm the wrong way." But Brown’s publicist, Michael Sitrick, insists much of the columnist’s report features inaccuracies, including the book deal details and the $10 million contractual agreement.
And Rihanna’s lawyer Donald Etra insists he knows nothing about the claims the columnist has made.
But Zwecker is standing by his story and his sources, telling U.S. news show Access Hollywood, "Project Mea Culpa is the name that is apparently being used by his (Brown) group (for this).
"(The deal) is obviously a kind of commitment from him to her (Rihanna) that he was serious about the fact that this will never happen again." After a brief split following the pair’s violent bust-up in Los Angeles, Brown and Rihanna are reportedly back together.
Brown was charged with two assault felonies on Thursday (05Mar09), related to his alleged attack on Rihanna, and will appear in court on 6 April (09) for a hearing.
If convicted, he faces almost five years behind bars.

RIHANNA’s lawyer has confirmed the singer will testify against her boyfriend CHRIS BROWN if she’s subpoenaed to appear in court as he fights two felony charges of assaulting her.
The troubled R&B singer is free on $50,000 (GBP35,700) bail after he was granted a continuance at his arraignment hearing on Thursday (05Mar09) - and he’s due back in court in a month (06Apr09).
At that point, his girlfriend, who he allegedly beat up in a late-night row a month ago (08Feb09), could be called to testify against him by prosecutors keen to punish the Kiss Kiss singer to the full extent of the law.
Rihanna did not appear in court for the arraignment hearing, but reports suggest she has reconciled with the singer and was in Los Angeles with him.
And she could be in court for the hearing on 6 April (09).
Her lawyer, Donald Etra, has told MTV News, "She is planning to do everything that the law requires her to do. If she is required to testify, she will do so." In court on Thursday, Etra was overheard telling Brown, "I think Rihanna would like this over as quickly as possible." And the lawyer tells Us Weekly magazine, "Rhianna desires that it (the case) be quick and expeditious. She wants to get back to her life and her career." Meanwhile, the judge overseeing the case has given Rihanna permission to tape conversations with her boyfriend.
If convicted, Brown faces up to four years and eight months behind bars.

DESPERATE HOUSEWIVES star EVA LONGORIA PARKER is turning waitress for a night, after donating her services for a charity auction.
The actress was the host at an event in Hollywood on Thursday (05Mar08), held to raise money for the New York Rescue Workers Detox Project - which benefits emergency workers injured during the World Trade Center attracts.
And she stepped in to boost the bidding on a catered meal for 12 - donated by her restaurant Beso - by throwing in a personal appearance.
Longoria-Parker promised to wear an apron and make her signature "tableside guacamole" - a favourite menu item at Beso - at the lucky bidder’s dinner party. As a result, bidding on the item soared to $37,500 (GBP26,400).
The auction winner will also get a pair of tickets to watch the star’s husband, Tony Parker, hit the basketball court with his team the San Antonio Spurs.
The actress was joined at the charity event by co-hosts Danny Masterson, Leah Remini and guests Simon Cowell and Wilmer Valderrama.

MARIAH CAREY and NICK CANNON have given up their house hunt in California’s San Fernando Valley - because they’re desperate to start a family over the hill in Los Angeles.
The thoughtful couple has been looking at schools as well as mansions, after deciding that Carey’s native New York was no place to raise a child.
But, two weeks after Carey splashed out over $200,000 (GBP142,800) on furniture at Beverly Hills’ trendy Kreiss store, she and her husband are still looking for a home to put it all in.
An insider tells WENN, "They still don’t have a house yet, but they do have an interior designer helping them make their choice and they’ve ruled out buying a place in the Valley.
"I don’t believe Mariah is pregnant yet but she and Nick are talking about having children and they want their kids to go to school in Los Angeles." Carey certainly doesn’t look pregnant, but onlookers spotted her declining alcohol during a recent business lunch with Cannon and advisors, while her husband sipped beer.
One diner at the restaurant the pop star chose for the luncheon says, "She drank ice tea. Maybe she just wanted to keep a clear head. She certainly didn’t look pregnant." Meanwhile, a new report in U.S. magazine In Touch Weekly suggests Carey, 39, has been paying visits to a Beverly Hills fertility expert.
She and Cannon were spotted holding hands and laughing as they left the Southern California Reproductive Center on 19 February (09).
Both Carey and Cannon, who wed last April (08), have spoken about their family plans, with actor/rapper Cannon hoping for a big family.
He recently said, "Maybe we’ll have as many (kids) as the Octo-mom." A source tells the publication, "Mariah has always wanted a baby."

Latina.com was the first website to suggest the Paper Planes hitmaker had given her month-old boy the odd moniker, but in a MySpace.com post, the rapper/singer insists she hasn’t decided on a name yet.
The angry mum writes, "MY BABY IS NOT CALLED ICKITT, PICKIT OR LICKIT THANK YOU VERY MUCH TO ALL THE HOLLYWOOD PRESS. HES A BABY, HE DONT NEED PRESS! Rap mogul SEAN ‘DIDDY’ COMBS has settled a copyright infringement lawsuit with fashion house Louis Vuitton, ending a dispute over product placement in various DANITY KANE videos.
The Bad Boy Records boss and heads at the label’s parent company Warner Music Group were sued by executives at the luxury label for unauthorised use of Louis Vuitton’s intellectual property.
In the legal papers, filed in Paris, France last August (08), Combs’ company was accused of using the Louis Vuitton logo in two of the girl group’s music videos, as well as in album packaging photos for their self-titled 2006 release.
The two parties reached a deal on Thursday (05Mar09). Combs has agreed to remove all visual references to the trademarks from future releases of the videos and album in question. That won’t be too tough as Danity Kane were disbanded last month (Feb09).
The financial terms of the settlement have not been released.
It is the second such legal matter Louis Vuitton bosses have settled in recent months - Sony BMG heads were forced to pay $150,000 (£106,380) after using the brand’s designs in albums and videos by stars like Britney Spears, Da Brat and Ruben Studdard.

Rapper-turned-reality TV star COOLIO has been arrested for possession of crack cocaine at Los Angeles’ LAX airport.
The Gangsta’s Paradise hitmaker, who recently completed a stint on British show Celebrity Big Brother, was on his way out of Los Angeles when security staff found drugs on his person.
TMZ.com reports Coolio, real name Artis Leon Ivey, Jr, became angry with a LAX screener after he was stopped while passing through security.
He was booked by police on Friday morning (06Mar09) and bail was set at $10,000 (GBP7,140).

The taxi firm the actress called to escort her from her New York home to the airport got her address wrong and when Gugino called to ask where her car was, they sent their best driver to lead her on a thrill ride.

Fans of the TWILIGHT vampire movie franchise really have something to sink their teeth into - the film’s star is counting on three sequels.
Actress Kristen Stewart has dismissed reports she’s already tiring of playing Bella in the movie adaptation of Stephenie Meyer’s hit book series - in fact she’s in it for the long haul.
She tells Eonline.com, "We all really hope there is going to be a number four. I’m pretty confident that the fans aren’t going to, all of a sudden, lose interest.
"The only case that a fourth one wouldn’t be made is if all of a sudden people stopped caring, and I really don’t think that’s going to happen." Stewart is currently preparing to start work on the Twilight sequel New Moon later this year (09).
