A chef who claims comedian JERRY SEINFELD’s wife plagiarised her cookbook has now accused the funnyman "scaring" her young daughter.
Chef Missy Chase Lapine sued Seinfeld’s wife Jessica in January (08), claiming Seinfeld’s bestselling cookbook Deceptively Delicious had been "brazenly plagiarised" from her own tome, The Sneaky Chef.
Both books describe how to hide healthy ingredients in children’s food.
Seinfeld’s subsequent appearance on U.S. TV show The Late Show with David Letterman - where he joked, "Many of the three-named people do become assassins" and called Lapine a "wacko" and "mentally unhinged celebrity stalker" - prompted the chef to add a defamation charge against the funnyman.
In federal court documents filed on Tuesday (28Oct08), Lapine says she "started feeling scared" by the incident.
She adds: "I have never felt so frightened and vulnerable as the day my daughter, seven years old, came home from school and asked, ‘Mom, what is an assassin?’ "I thought I made a big mistake talking to any reporters because now this billionaire is angry and attacking me everywhere.
"I do not suffer from any mental infirmity. I am not a celebrity stalker. I am not a violent or dangerous person." Seinfeld’s lawyers are vying to get the defamation suit against him dismissed, insisting "mocking the litigious nature of society" is protected by his First Amendment right to freedom of speech.

The son of Hollywood actor BILL PULLMAN has been arrested on charges of assault, underage drinking and possessing moonshine.
Jack Pullman, 19, was reportedly arrested with a 19-year-old friend in North Carolina on Monday night (27Oct08).
He also faces a charge of assaulting a government official.
According to a local ABC network affiliate, both men have been released from police custody. No further details were available as WENN went to press.

The family of late blues guitarist JEFF HEALEY are furious with a record label for distributing an "unauthorised" disc featuring the star.
The Jeff Healey Band - Legacy: Volume One is set to be released by Canadian label Arbor Records and distributed by EMI Music Canada.
But the star’s family insist they have not given the label permission to put out the record.
The disc - set for release next month (Nov08) - includes unreleased material and appearances by George Harrison, Paul Shaffer and Jeff Lynne.
The family claim the content of the album came from former Jeff Healey Band drummer Tom Stephen, who was engaged in a legal battle with Healey over alleged unpaid royalties.
Healey’s wife Cristie said the family are "deeply and sadly disappointed" to hear that the LP is set for release.
She says, "We ask that Jeff’s fans please refrain from purchasing this compilation out of respect for Jeff and his family. This release is not authorised or supported in any way by Jeff’s estate".
Healy died after a battle with cancer in March (08). He was 41.

LATEST: British comedian RUSSELL BRAND has quit his job as a BBC radio presenter following his controversial prank calls to actor ANDREW SACHS.
During four calls, which were aired on Brand’s Radio 2 show on 18 October, he and fellow broadcaster Jonathan Ross recorded voicemail messages on Fawlty Towers star Sachs’ phone, in which they discussed Brand’s fling with the 78-year-old’s granddaughter. The pair also joked about breaking into his house and molesting him, although that dialogue was cut from the aired broadcast.
Sachs was outraged - along with thousands of listeners, who lodged complaints, prompting the broadcaster to suspend the pair on Wednesday (29Oct08).
But Forgetting Sarah Marshall star Brand resigned later the same day, insisting he takes "complete responsibility" for the incident.
A statement reads, "As I only do the radio show to make people laugh I’ve decided that, given the subsequent coverage, I will stop doing the show.
"I got a bit caught up in the moment and forgot that, at the core of the rude comments and silly songs, were the real feelings of a beloved and brilliant comic actor and a very sweet and big-hearted young woman."

FALL OUT BOY star PETE WENTZ considered quitting the band after nude pictures of him were posted on the Internet.
The bassist admits he was humiliated after the risque photographs emerged online, and claims the incident is the darkest point of his career He says, "I remember calling (bandmate) Patrick (Stump) and saying I quit.
It’s the equivalent of someone walking in on you in the shower apart from it is on Google. It’s not fun.
"There have been a few low points as people are well aware of." And Wentz denies posting the images on the Internet to garner more publicity for his band.
He adds, "The first thing that I would think if I saw the pictures would be that they released them themselves but it wasn’t. I would have done a better job if I’d released them myself."

Rocker JOHN MAYER has become the latest Hollywood star to publicly endorse BARACK OBAMA for U.S. president, urging critics of the politician’s message of "hope" to reconsider.
The 31-year-old singer has made a last minute bid in support of the Democratic candidate less than a week before the history-making election next month (04Nov08).
In a column for online blog The Huffington Post, Mayer writes: "Obama gives me the feeling that I could be alive to witness one of the most brilliant upturns in a country’s history. What a concept. That’s why hope is a worthwhile commodity. To those who question whether hope is a tangible product worth building a campaign around, I’d say take a look at despair and how powerful that has been in reshaping how people think and live.
"I believe the definition of the ‘hope’ that Barack Obama enthuses operates on the unspoken thesis that there has to be a polar opposite to the despair of 9/11. Because if we accept that there’s not, the will to live becomes forever altered.
"To adults who will vote for him, Barack Obama represents a return to prosperity. To the youth, he represents an introduction to it."

JOHN LENNON’s son SEAN still hurts when he hears BEATLES songs, 28 years after his father was murdered.
Sean was just five years old in December 1980 when the singer was shot dead outside the family’s New York City apartment by crazed Mark Chapman.
But he tells Lennon biographer Philip Norman he finds it hard to hear his dad’s voice.
Sean - whose mother is Yoko Ono - says, "It took a good ten years before hearing his voice wasn’t an incredibly difficult thing.
"If I’m at a party and someone casually puts on Sgt. Pepper, it’s hard for me. I can’t just hang out, drink wine, smoke cigarettes and listen to those songs." Lennon Jr’s words appear in Norman’s book John Lennon: The Life.

50 CENT has urged rap "rival" KANYE WEST to look to him as a mentor - insisting it will help him avoid embarrassing incidents with the paparazzi.
West and his assistant were arrested following a scuffle at Los Angeles LAX airport last month (Sep08), when the rapper allegedly damaged a photographer’s equipment.
Charges of felony vandalism were later dropped by the Los Angeles County District Attorney’s office.
But the In Da Club hitmaker is convinced West will learn to deal with snappers over time.
He tells the New York Daily News:, "You’ll see artists like Kanye West, he recently had a little incident in the airport. After he’s been successful for a longer period, he’ll let that frustration go without incident.
"I’ve had enough time to get used to the fact that people might want to take my picture when I don’t want it taken, but I accept it."

Hollywood beauty JESSICA BIEL regrets being pressured into topless shots for a US men’s magazine.
The Texas Chainsaw Massacre star, 26, was persuaded to pose for the racy pictures in 2000 to shed her angelic image.
But she admits she now rues agreeing to the photoshoot.
She says, "It was supposed to show me being sexier and more mature. The idea was: Look at me- I am a woman, growing up. I had male managers at the time, who were really excited about the photoshoot.
"The truth is, though, I was in way over my head. I remember calling my dad and saying: ‘I screwed up. I went too far and did not stand up for myself.’"

New BOND girl OLGA KURYLENKO has not ruled out marriage in the future - despite having two divorces behind her at the age of 28.
The Ukrainian actress split from photographer Cedric Van Mol in 2003, after four years of marriage. She went on to marry businessman Damian Gabrielle in 2006, but they divorced just one year later (07).
But Kurylenko insists she is open to getting married once again if she finds the right person.
She says, "I have not been scarred by my two divorces. The important thing is that I loved them - and you cannot regret loving.
"I am glad to have spent a part of my life with my two ex-husbands. If I had to go back I would do it again. My divorces were not a sad experience. It’s just communication.
"People who surround us in our life exchange more and more experiences with us. I learned I had differences from them and they were different people from me.
"My ex-husbands were different nationalities but were both very interesting people. I don’t see divorce as a failure. I see it as the end to a story."

Actor PATRICK SWAYZE rejected countless TV roles before he signed up to star in forthcoming series THE BEAST - because he considered television a step-down for a Hollywood movie star.
The Ghost actor is scheduled to continue filming the show until November of this year (08).
But he admits it took years of convincing to return to the small screen after his success in blockbuster films.
He tells the New York Times, “I thought I was (Robert) De Niro… If I’m going to do television, I wanted that (1985 mini-series) North and South experience. I wanted something that’s going to challenge me on a constant basis.
"To be honest, I’ve made a game out of trying to live through my James Dean, Janis Joplin, Freddie Prinze, Jim Morrison period, those demons that we all have that we’re either successful or not at making (it) work for us rather than destroy us.”

Actor-turned-author DENIS LEARY has apologised for his scathing remarks against children suffering with autism - insisting his quotes were taken out of context by the media.
The Rescue Me sparked outrage among activists for young autism sufferers when an excerpt from his book Why We Suck: A Feel-Good Guide to Staying Fat, Loud, Lazy and Stupid was printed in a U.S. newspaper earlier this month (15Oct08).
In the book, Leary claims some parents use the brain development disorder as an excuse to explain their children’s "laziness", and blames the surge in autism on "inattentive mothers and competitive dads".
But Leary has taken a step back since landing in hot water over the remarks.
He tells the Boston Herald, "I apologise for any pain the out-of-context quotes from my book may have caused."

Rockers DAVID BOWIE, THE CLASH, NIRVANA and THE SEX PISTOLS are among a host of stars who will be remembered in the first major sale of punk-rock memorabilia later this year (08).
Christie’s auction house has put together a collection of classic items, including signed publicity photos, posters and clothing from the height of the punk movement in the 1970s.
A Sex Pistols press kit from 1977 is expected to bring the highest price at about $6,000 (£3,739).
A spokesperson for Christie’s tells the New York Post, "These were kids, and kind of snotty kids at that. For them to be signing publicity shoots is quite rare." He says the collection "basically tells the history of the whole punk era and… people who were influenced by the punk era. It has all the great names, from (David) Bowie to Lou Reed to Patti Smith to the Ramones, Sex Pistols, Clash, all the way to Nirvana, which is obviously an outgrowth." The auction is scheduled for 24 November (08) in New York.

MILEY CYRUS has reportedly become "a nervous wreck" after the FBI raided the home of a hacker who allegedly leaked candid photos of the star on the internet - because she fears he’s passed on her personal information to someone else.
Federal agents raided the Tennessee home of Josh Holly last week (beg20Oct08), seizing computer equipment from the 19-year-old.
Holly became a prime suspect in the federal investigation after police learned he had allegedly bragged to pals about unlocking the Hannah Montana star’s email account and flooding the internet with racy snaps of her.
And Cyrus is reportedly terrified that more personal information will be made public despite the government’s involvement.
A source tells the National Enquirer, "She used that email account on a daily basis to send (former boyfriend) Nick (Jonas) and several of her friends photos and letters. And there were several other accounts Miley used for emails, so she’s not exactly sure what Holly gained access to - and that’s what so deeply troubling to her… The whole thing is making Miley a nervous wreck."

British boyband TAKE THAT have urged fans to buy tickets for their concerts instead of rockers OASIS’ upcoming live dates - insisting their gigs are better value for money.
The two groups are both kicking off their new stadium tours in June 2009, with both bands playing shows at several of the same venues just days apart from each other.
And the Pray hitmakers are adamant music fans should buy tickets for their show - because Oasis "just stand around and sing".
Take That star Howard Donald says, "There’s a totally different energy to the two shows. We’re all about the spectacle, putting on an amazing show for the fans, with lots of high energy and dancing.
"Oasis are great - if you just want to see a band stand still and sing. They have a different kind of energy." Fellow bandmember Mark Owen adds, "I really want to go and see Oasis but if finances make people choose one or the other, then come and see us." In 2000, Oasis frontman Liam Gallagher was famously embroiled in a war of words with former Take That star Robbie Williams, who challenged the rocker to a boxing match after Gallagher referred to the singer as "the fat dancer from Take That" in an interview.

LATEST: Police probing the murders of JENNIFER HUDSON’s mother, brother and nephew are investigating the possibility more than one person was involved.
Officers are quizzing suspect William Balfour after the Oscar winner’s mother Darnell Donerson, brother Jason, and seven year old nephew Julian King were shot dead in Chicago, Illinois.
The bodies of Darnell and Jason were found at the family home on the day of the shooting last Friday (24Oct08), and Julian’s body was discovered three days later in a car in the city.
Now cops are probing the theory that the killer had an accomplice who helped to drive him from the murder scene.
According to the Chicago Tribune newspaper, witnesses said Balfour drove his Chrysler to the Hudsons’ home on Friday, but the vehicle was later found by police parked a mile away on the city’s South Side.
Balfour’s girlfriend is said to have told officers he was at her home on the West Side not long after the slayings.
And although security cameras picked up footage of an unknown person parking the car outside a school shortly after the shootings, cellphone records placed Balfour on the West Side at the time the car was dumped.
Officers believe that if the timings are correct, it would mean the killer had an accomplice.
Balfour has not been charged in connection with the murders, and is being held for parole violation.
