BRITNEY SPEARS’ trial for driving without a license has been scrapped, after a Van Nuys, California jury failed to reach an unanimous decision.
After more than two days of deliberating, jurors returned to court on Tuesday (21Oct08) to reveal they were deadlocked, with two members voting guilty, and 10 not guilty - forcing the judge to declare a mistrial.
Prosecutors now have to decide whether to ask for a retrial.
After declaring the mistrial, Judge James Steele dismissed a criminal charge against the pop star.
Spears was on trial for driving without a valid California license.
Earlier this month (Oct08) the singer rejected a plea deal that would have saved the case from going to trial - because it would have left her with a criminal record.

PARIS HILTON has celebrated her eight-month anniversary with rocker BENJI MADDEN by phoning home from London to clear up royal romantic rumours.
The socialite called in to pal Ryan Seacrest’s radio show in Los Angeles on Tuesday morning (21Oct08) to address British tabloid reports she has been caught flirting with British Princes William and Harry after meeting the royal brothers at the London Hilton.
Hilton told Seacrest she has met with William and Harry - but there’s nothing to the rumours, and she’s not texting love notes to either of them.
She said, "They’re very nice boys, very down to earth and sweet but there’s nothing romantic going on at all. They just came up and said hello. There’s no texting going on; I’m reading that I invited them to Las Vegas to a club - that never happened.
"I have a boyfriend, it’s an eight month anniversary today. I would never say that in a million years and it just annoys me that particularly the media out in the UK, they will not only make up stories, they’ll also go as far to make up quotes that I supposedly said.
"William was really nice… Harry was with his girlfriend, Chelsea, who was so stunning, beautiful and sweet… They were just very friendly, they weren’t flirting at all.
"I’m taken, I don’t put it out that I’m single. Before, I wasn’t in love… I would never hurt him (Madden)." Hilton admits she’s also upset with reports Madonna’s estranged husband Guy Ritchie treated the socialite to a tour of his Sherlock Holmes set - and offered her a role in the new film.
She added, "I didn’t even know there was a Sherlock Holmes movie… It’s so ridiculous.
"I did meet him (Ritchie) at his pub (The Punch Bowl) and he was very nice." Meanwhile, Hilton, who is in London shooting a British version of her reality show My BFF is planning a very romantic weekend with Madden, who flies to the U.K. weekly to hang out with his girlfriend.
She says, "There’s a big carnival fair here so we’re gonna go on some rides and then go for a nice dinner and hang out in the room." As an eight month anniversary gift, Madden had roses and caviar delivered to Hilton’s hotel room this morning.

LINDSAY LOHAN is facing a lawsuit from three men who claim she hijacked a car and held them hostage last July (08).
Ronnie Blake, Jakon Sutter and Dante Nigro accuse the star of commandeering the SUV they were passengers in, after a party in Malibu, California.
She then drove off in the car and was stopped by police on the Pacific Coast Highway after running a red light.
The officers arrested Lohan for driving under the influence (DUI). They also found cocaine on her possession. The incident resulted in a second DUI charge in just three months for the actress - and led to an infamous 84-minute jail sentence.
Papers filed at Los Angeles County Superior Court this week (20Oct08) allege Lohan was intoxicated and "hostile" and "endangered" the mens’ lives during the ‘joyride’. She allegedly told them, "She was a celebrity… she could do whatever she wants." But Lohan’s lawyer Ed McPherson has dismissed the lawsuit, telling TMZ.com, "These guys had the night of their lives."

BEYONCE KNOWLES’ parents are to be honoured with a major award for their children’s charity efforts.
Mathew and Tina Knowles are to receive the esteemed National PTA Commitment to America’s Children Award.
The award presentation will take place at a gala next week (30Oct08) in Chicago, Illinois.
Cash the charitable couple have raised and donated have helped to build youth centres and apartments in America, and the pair also created the Survivor Foundation with their daughters Beyonce and Solange and singer Kelly Rowland.

Actors JULIA STILES, HUGH DANCY, JUSTIN LONG, CYNTHIA NIXON, ROSIE PEREZ, JULIANNA MARGUILES, LIVE SCHREIBER and BRITTANY SNOW are among the starstudded ensemble cast of this year’s The 24 Hour Plays On Broadway.
The event will kick off in New York on Sunday 16 November (08), when a group of six writers will be given a nine hour deadline to each write a ten-minute play.
Six directors will then have one hour to read each play before spending 12 hours rehearsing with each cast.
The plays will then be performed to a live audience at 8pm on 17 November (08) at Manhattan’s American Airlines Theater.
All proceeds will benefit the Urban Arts Partnership, which promotes the arts in New York schools.

SPIDER-MAN director SAM RAIMI has hinted the fourth and fifth installments of the hit movie franchise could be shot simultaneously.
A fourth Spider-Man movie is due for release in 2011 with original superhero star Tobey Maguire returning as the web-slinging crime fighter.
But Raimi reveals comic book fans could be treated to a double helping of Spider-Man, with the films being shot back-to-back, like the Lord of the Rings movie sequels.
He tells MTV News, "I don’t have a script yet, but production would start probably by March of 2010, I’m guessing. It sounds like a long time away, but we need a script first, and a lot of pre-production has to take place.
"(Shooting two sequels simultaneously) has been talked about… I don’t think it has been decided yet, and she (Sony Pictures co-chairman Amy Pascal) is the one that’s really going to make that decision; I’m really curious myself."

Action thriller EAGLE EYE has soared to the top of the international box office chart taking $11.1 million (£6.4 million) in 42 markets.
The film, starring Shia LaBeouf, leaves George Clooney and Brad Pitt’s crime comedy Burn After Reading in second place with $8.7 million (£5 million).
Mark Wahlberg’s outing as Max Payne debuts in third position, taking $6.9 million (£3.98 million) globally - just over a third of its $18 million (£10.4 million) profit from the U.S. box office.

PRISCILLA PRESLEY has described her daughter LISA MARIE’s newborn twins as "a dream come true".
Elvis Presley’s widow became a gran for the third and fourth time on 7 October (08) when Lisa Marie, 40, welcomed Finley and Harper, her first kids with husband Michael Lockwood.

AEROSMITH star BRAD WHITFORD fears time may be creeping up on the ageing rockers - blaming old age for the foot injury which landed frontman Steven Tyler in rehab earlier this year (08).
Tyler checked into a facility in Pasadena, California in May (08), later revealing he was in rehab on doctor’s orders because of a foot injury.
He has since confessed he was fighting a dependency on pain and sleep medication he needed to cope with pain of the injury.
The band has been hiatus in anticipation of Tyler’s fully recovery so they can finish their next studio album.
But guitarist Whitford doesn’t blame the injured star for holding back recording - insisting his plight has increased his own fears for the band’s mortality.
He tells Billboard.com, "You have more than average concerns about it (injury), I guess, but you can’t do anything about it.
"Like a lot of other things in life, you don’t get to call the shots on these things, do you? We’re just … getting older."

Rapper T.I. has been forced to pull the promo for his new single SWING YA RAG after he was accused of copyright infringement by fashion houses Louis Vuitton and Gucci for featuring its products in his video.
The Live Your Life hitmaker had to scrap plans to debut the promo on TV after receiving complaints about the designer scarves he and his entourage use in the clip.
He tells MTV, "We did it (the video) and it came out hot. Louis (Vuitton) and Gucci started trippin’ about it. They were saying we were infringing, in one way or another. They weren’t happy about it. They didn’t want it to come out.
But it’s hot, though."

The man whose alleged kidnapping and murder exploits inspired JUSTIN TIMBERLAKE’s film ALPHA DOG has been denied an appeal.
California’s High Court authorities have agreed Jesse James Hollywood can get a fair trial in an infamous 2000 slaying, despite the fact his crimes were heavily referenced in the 2006 movie, which also starred Bruce Willis and Sharon Stone.
Fugitive Hollywood was captured in Brazil after the film wrapped in 2005 and now Santa Barbara, California prosecutors have been given permission to proceed with the trial. He faces the death penalty if found guilty.
Hollywood is accused of orchestrating the kidnapping and murder of 15-year-old Nicholas Markowitz in August 2000.
Ron Zonen, the prosecutor in the case, originally agreed to co-operate with Alpha Dog director and screenwriter Nick Cassavetes in the hope that publicity from the film might help him find Hollywood.
The accused’s legal team argued that Zonen and the Santa Barbara County district attorney’s office should be disqualified from the case, citing a conflict of interest.
California Supreme Court judges disagreed in May (08) and on Monday (20Oct08), the High Court turned down an appeal from Hollywood’s lawyers.
Hollywood’s trial is scheduled to begin in February (09). Zonen will not be part of the prosecution.
Before the trial begins, a judge will also consider a motion to move the prosecution elsewhere.
Hollywood’s associate, Ryan Hoyt, has already been convicted of Markowitz’s murder and sentenced to death.

Country rocker BRAD PAISLEY was hauled off in handcuffs by cops at Nashville Airport in Tennessee on Sunday (19Oct08) after his singer pal JEWEL arranged for him to be ‘arrested’.
The shocked star was nabbed by two uniformed men as he arrived home in Nashville after completing his tour with Jewel.
But he realised he was the victim of a practical joke, when the officers told him, "We have a Miss Jewel Murray who has filed 42 charges against you in the states of Texas and Tennessee for excessive noodling." Murray is Jewel’s married name after she wed rodeo star Ty Murray this summer (08).
A laughing Paisley told People.com, "This is absolutely as good as it gets.
This is the best I’ve ever been had." Paisley has a reputation for pranking his tourmates; he once imprisoned Jack Ingram in a PVC pipe cage onstage; and tricked Chuck Wicks into thinking he had been dumped by his girlfriend Julianna Hough.

SAMUEL L. JACKSON is confident fans of late comedian BERNIE MAC will enjoy his appearance in new movie SOUL MEN, describing it as "a fitting last performance".
Jackson - who stars in the movie with Mac and blues legend Isaac Hayes, who also died this summer (08) - refuses to let their passing upset him as he promotes the new film, because he’s convinced Mac is laughing about the situation up in heaven.
The Pulp Fiction star says, "He would have found a way to make a joke about it. He would have been poignant, and then he would have been funny." Mac, who had previously suffered from lung disease sarcoidosis, struggled with bad health during shooting for Soul Men, but refused to let his personal troubles affect his work.
Jackson claims the Ocean’s Eleven star fans will see in the musical film was "the Bernie Mac that they knew and loved; the Bernie Mac that came into their homes every week, who made them pee on themselves when he was doing his act.
It’s a fitting last performance." And the actor feels honoured to have worked alongside Hayes, who died just one day after Mac.
Jackson and Mac play a reunited soul duo, singing hits from Hayes’ label Stax Records - and the Hollywood star admits he was wracked with nerves singing in front of the multiple Grammy winner.
He explains, "To do an Isaac Hayes song in the middle of the film while he’s sitting there watching us (was) a little daunting.
"But then you look at him and you see he’s (nodding his head). So you think ‘All right, we’re killing it.’" Mac, 50, died on 9 August (08) after suffering complications from pneumonia, while Hayes, 65, passed away on 10 August (08). He is thought to have died from a stroke.

SIR ELTON JOHN angered fans who had paid up to $2,500 (£1,400) for tickets to a benefit performance in New York on Monday (20Oct08), when he only appeared onstage for the final three songs.
The legendary rocker staged the event to celebrate the 35th anniversary of his iconic double-album Goodbye Yellow Brick Road, with ticket sales benefitting AIDS charities, including his own Elton John AIDS Foundation.
The LP was played in its entirity by a host of theatre and chart performers including Jane Krakowski, Ben Folds, Rufus Wainwright and Jake Shears.
But some fans at Broadway’s New Amsterdam Theatre grew restless for the star himself to perform, yelling angry chants of "I want my money back" and "where’s Elton", reports RollingStone.com.
John finally appeared for the final three songs - Roy Rogers, a duet of Social Disease with Jake Shears and an ensemble performance of Harmony.

A male BEYONCE KNOWLES fan has been arrested in Connecticut for reckless driving after alleging he was on his way to a romantic liaison with the married R&B superstar.
Thirty-three year old Robert Williams Jr., from Michigan, was taken into custody in Milford on Sunday (19Oct08) after almost smashing into a police car.
Officers claim he stopped to ask police for directions to Detroit, Michigan before driving off, narrowly missing the cop car and driving over a sidewalk.
Williams, who had flowers and a teddy bear in the car, is also alleged to have asked the cops if they were escorting him to New York City, where he claimed the Crazy In Love singer had agreed to meet him at the George Washington Bridge.
Knowles, who is married to rapper Jay-Z, was not contacted by police and officers added Williams had not made any threatening remarks about the singer.
The man was arrested and charged with erratic driving, speeding and other traffic offences, and was taken to a local hospital for a mental evaluation.
He is due to appear in Milford Superior Court on 4 November (08).
