WILL SMITH has been given a 40th birthday gift by Warner Bros. bosses - the chance to reprise his I AM LEGEND character ROBERT NEVILLE in a prequel to the 2007 blockbuster.
Movie executives have greenlighted the film on the movie star’s birthday (25Sep08), confirming Francis Lawrence will return as the director and D.B.
Weiss will pen the script.
Smith’s scientist character was killed in the last film.
And it’s not the only Will Smith action/sci-fi blockbuster set for a second outing - the birthday boy’s Hancock co-star Charlize Theron has hinted at a sequel.
In a recent interview with MTV, the actress said, "If everybody’s on board, I would be an idiot (not to do it)… Riding the Will Smith train is a really nice train to ride."

The lawyer who helped the ROLLING STONES and ROBIN WILLIAMS in legal battles has died.
Gerald Margolis was 65 when he died at a health centre in Santa Monica, California on 15 September (08).
As well as representing the Stones and Williams, Margolis, who coined the famous "Don’t ignore the media" catchphrase, also provided counsel to R. Kelly in his recent child pornography trial. The soul singer was vindicated this summer (08).
Among his big court wins, Margolis defended Mick Jagger and Keith Richards over alleged copyright infringement by the Rolling Stones.

JADA PINKETT SMITH is set to return to TV to play a hospital nurse.
The actress will star in upcoming U.S. medical drama Time Heals.
It will be her first regular TV role since she quit A Different World in 1993.
She’ll play a single mum who is the director of nursing at a North Carolina hospital, according to The Hollywood Reporter.
The 37-year-old star will double as the new show’s executive producer.

Movie legend SIDNEY POITIER has been exposed as a love cheat by actress DIAHANN CARROLL in her new autobiography.
The respected film icon reportedly promised to wed Carroll after the couple met and fell in love on the set of 1959 musical Porgy & Bess, but when Poitier allegedly locked her out of the New York apartment they were to share as man and wife, she knew the romance was over.
In her new book The Legs Are The Last To Go, the 73-year-old former Dynasty star reveals she even split from her husband Monte Kay so she could marry Poitier - but he refused to leave his first wife Juanita.
She tells America’s the Globe, "I was about to move in (with him) when he told me he didn’t want me there. He changed the locks so I couldn’t get in.
"Then he made me write him a cheque to offset his purchase and decorating costs." Despite the messy break-up, Carroll reveals she fell for Poitier again on the set of Paris Blues in 1960. Again, the actress dumped her husband, with whom she had reconciled, but the actor would not leave the wife he was cheating on.
Carroll adds, "He loved me, but he also loved his wife, a good Catholic woman who stuck with him through his worst years." The affair continued until Poitier backed out of plans to divorce his wife a third time. Carroll eventually split from her lover before he finally did leave Juanita.
But, despite all the heartbreak, the actress insists she and Poitier are "now friends," adding, "That’s a lovely thing that comes as you age - forgiveness."

Playboy boss HUGH HEFNER has taken to the airwaves to squash rumours he’s planning to settle down and start a family with girlfriend HOLLY MADISON.
Hefner has also dismissed reports the same woman, who shares the tycoon’s bed with two other Playboy blondes, is dating illusionist Criss Angel.
Appearing on Ryan Seacrest’s radio show in Los Angeles on Thursday (25Sep08), Hefner was keen to clear up rumours about his trio of girlfriends.
After rumours that his girlfriends Holly and Kendra are cheating, Hugh Hefner called Ryan to set the record straight, stating, "Everything is fine… lots of rumours, lots of gossip, but things are good." And when pressed about the pregnancy stories which have dogged Madison for the past 18 months, Hefner insists his number one girlfriend will have to wait until she moves out of the Playboy mansion to start a family.
He added, "Holly would like very much to get married and have children understandable. That’s out there in the future with someone (else)."

Single star SHIA LaBEOUF has set his romantic sights on newly-unattached actress DREW BARRYMORE, after confessing the CHARLIE’S ANGELS beauty was his first crush.

Gossips claim new Oscars bosses Laurence Mark and Bill Condon were impressed with The Office creator’s laugh-raising stint at Sunday’s (21Sep08) Emmy Awards, and they want to audition him for the Oscars.

Pop star PINK hates both her birth name and her music moniker, insisting neither give her an identity.
The singer has been known as Pink since her childhood and carried the name through her music career, but now she admits she is not a fan of the colourful nickname - nor her birth name, Alecia.
She says, "When people call me Alecia Beth Moore, I cringe. I feel like I’m grounded all over again. It’s like (movie character) Mommie Dearest is going to come out with a wire hanger.
"I don’t feel like Pink either. I feel like I’m a soul walking around. I don’t feel defined by the name… I just feel like a really strange girl."

LATEST: Rapper BUSTA RHYMES has been allowed into the United Kingdom, after spending hours detained at London’s City Airport over "unresolved convictions" in the U.S.
Immigration officials at the airport stopped Rhymes on Thursday (25Sep08) morning and attempted to re-route the rapper to Amsterdam, Holland - until Rhymes’ lawyer secured an injunction preventing the move.
After holding him for several hours, the authorities have now granted the star permission to enter the country, where he is due to perform a charity concert at London’s Royal Albert Hall on Friday (26Sep08).
The 36-year-old’s detention is thought to relate to previous convictions for drink driving and assault. Oddly, there was no drama when Rhymes, real name Trevor Smith, visited the U.K. just a month ago (Aug08).
Stephen Greene, the man behind the rapper’s charity concert for RockCorps, says "(I’m) shocked at this sequence of events and this treatment of Busta. He has the necessary work permit and has been in the country twice already this year, so we’re a little puzzled that a question mark is now being placed over his ability to enter the country."

Canada’s Green Party leader has apologised for never smoking cannabis.
Elizabeth May recently unveiled her party’s election manifesto – ahead of the upcoming Canadian general election - which includes a proposal to legalise the drug.
She said: “I am not a fan of marijuana use. I have to confess this, I know all politicians are asked. I’ve never used marijuana. I apologise.” The party wants to sell marijuana to adults through licensed distribution outlets, and estimates the plan would raise CA$1 billion in tax yearly.
The Green party currently holds one parliamentary seat.

Dutch police fined a man for smoking cannabis – because his cigarette contained tobacco.
Holland introduced a smoking ban in restaurants and cafes in July, meaning although the public can still smoke cannabis in establishments, smoking tobacco is prohibited.
An Amsterdam police spokesman said: “For logic it is sometimes impossible to explain, even to the Dutch. The man was not fined for smoking a cannabis joint but for smoking. You can smoke cannabis but not tobacco in coffee shops.” The 27-year-old man owns a coffee shop in the city and was fined after he was caught rolling a cigarette with tobacco and cannabis during a routine police check.
He is expected to contest the charge in court.

An American man was hit by a car and run over by a train in one day.
Robert Evans from Colorado was knocked down by a car in a hit-and-run incident and was taken to hospital.
His injuries were not serious, meaning he was released five hours after the accident occurred.
On his way home from hospital, Robert walked his bicycle over a railroad bridge where he was hit by the train, a mere six hours after his first accident.
He lay injured in a nearby creek for one-and-a-half hours before he was discovered and taken back to hospital.
His injuries were not life-threatening.

A Sydney man famed for giving free hugs is donating one of his kidneys to a stranger.
Juan Mann – who became famous for giving cuddles to anyone who asks after footage of him hugging people appeared on video sharing website YouTube – claims he will be undergoing surgery next year.
He said: “Apparently once you give your kidney you will never feel whole. But I’ll get a cool scar and apparently chicks dig scars.” Juan, 26, will undergo rigorous psychiatric and physical tests before he is allowed to donate the organ.
He added: “I am young, I am fit, I am healthy, I have two kidneys. I don’t need that second one and someone will be able to get out of hospital.”

An Italian man has been fined £400 for throwing his wife’s cat out of the house.
Allessandro Marchesi became furious when the cat, Ivano, urinated in his briefcase, and so put him out on the balcony of his home.
When his wife Laura discovered what had happened she was so angry she contacted Italian Animal and Environment Defence Association, who got in touch with specially trained lawyers.
Laura claimed Ivano was shivering and hungry after he was forced to spend the night outdoors.
A court ordered Allessandro to pay £400 for vet’s expenses and emotional damage.
Laura said: “I love my cat very, very much and what happened to it affected me deeply. It is only fair that I receive some compensation.”

A university student blackmailed her roommates into becoming fat.
Li Jiao of Hefei city, China convinced her five roommates she was the daughter of a gangster boss who would make them “disappear” unless they did exactly as she said.
Li demanded Qing Qing put on 33lbs in one month. When Qing failed, Li banned her from washing her face for three months.
She went on to force her other roommates to pile on weight, and demanded £800 for cosmetic surgery and slimming aids.
She also threatened to sell her flatmates into prostitution unless they gave her money.
Li has been charged with blackmail and reportedly told police she made up her gangland connection for “fun”.

An American woman has been arrested for bartending naked.
Janet Brannon, 33, was allegedly wearing no clothes as she served customers at the Cabin Tavern in Deli, Illinois when police stopped at the bar for a routine check.
Janet – who was the only member of staff working in the establishment at the time - was taken into police custody and charged with misdemeanour public indecency.
Jersey County State’s Attorney Ben Goetten said: “In addition to the charges against the bartender, the county will also seek charges against the owners of the Cabin Tavern.” Janet was eventually freed on $8,000 bail.
