KROEGER’S BREATH TEST BATTLE DISMISSED
Canadian rocker CHAD KROEGER has lost the first round of his battle against police who arrested him in Surrey, British Columbia in 2006.
The Nickelback frontman accused police of illegally obtaining breath samples from him during a drink driving arrest, but a judge has dismissed the claims.
Kroeger, real name Chad Turton, was pulled over for speeding on 22 June, 2006.
He faces charges of impaired driving and driving with a blood alcohol level over .08 - the legal limit.
Kroeger’s lawyer, Marvin Stern, argued a police officer conducted an unlawful search of his client’s Ferrari after detecting the smell of alcohol on the rocker’s breath.
Stern insisted that the field breath test results should be thrown out of court, but Judge Peder Gulbrandsen disagreed.
Kroeger’s case was adjourned until 12 March (08).
Last year (Nov07), the rocker pleaded not guilty to drink-driving. If found guilty, he faces a $600 (£300) fine and a one-year driving ban.
