KEVIN FEDERLINE’s attorney has praised BRITNEY SPEARS’ former bodyguard for coming forward with his concerns about the pop star’s mothering skills because he helped win the rapper physical custody of his two kids.
Troubled Spears has been ordered to hand over her sons Sean Preston and Jayden James to her ex-husband on Wednesday (03Oct07) after reportedly ignoring a string of court-imposed demands and skipping mandatory drug tests.
And Federline’s lawyer Mark Vincent Kaplan, who requested an emergency hearing to address Spears’ ongoing problems on Monday (01Oct07), insists ’secret witness’ Tony Barretto, who was fired as Spears’ bodyguard in May (07), was a big help.
Barretto wasn’t required to testify against his former boss but went public with claims of drug abuse and nudity around her kids.
Kaplan insists his comments helped, and has thanked attorney Gloria Allred for bringing the bodyguard forward.
He says, "I appreciate Gloria facilitating her client coming forward when he did. Today’s proceedings did not involve his testimony. He may be called as a witness in the future." Meanwhile, Allred is celebrating Federline and Kaplan’s win, stating, "removing custody from Ms Spears is the shock treatment that Britney Spears needs.
"My client… believes that she loves her children and that the children also need their mother.
"We hope that this change of custody will give her the strong incentive that she needs to get help so that she can one day be the responsible parent the children deserve to have."

Veteran rocker SIR MICK JAGGER has dismissed reports THE ROLLING STONES are planning to retire.
The Brown Sugar singer will use his "own judgement" to decide when its time to disband the rock supergroup.
He says, "I’m sure the The Rolling Stones will do more things and more records and more tours. We’ve got no plans to stop any of that really.
"As far as I’m concerned I’m sure we’ll continue."

SIR SEAN CONNERY has beaten his movie son HARRISON FORD to claim the Favourite Over-60 star in a new online poll.
Movies.com asked fans to vote in a series of categories for the website’s second annual Readers’ Poll Awards - and filmgoers picked Connery over his Indiana Jones & The Last Crusade co-star as their favourite aged star.
The website’s visitors also picked Johnny Depp as their favourite actor and Kate Winslet as their favourite actress.
Hit TV show Heroes was voted the TV Show You Want To See On The Big Screen and Carrie Underwood claimed the quirky American Idol Most Likely To Next Star In A Movie prize.
The Lord Of The Rings: Return Of The King was named Favourite Movie and the film also claimed the Favourite Soundtrack honour.

Things are going from bad to worse for BRITNEY SPEARS - she’s now caught up in a new sex tape scandal.
A day after losing physical custody of her kids to ex-husband Kevin Federline, an unnamed 28-year-old man has come forward with sex tales.
The mystery guy claims to have bedded Spears while she was vacationing on Hawaii in June (07) - and he caught the sexploits on camera.
And Spears’ one-night-stand lover insists the only thing that has been stopping him from going public with the sex tape is the fact he wasn’t happy with his own performance which he caught on camera.
He tells America’s In Touch Weekly magazine, "It was just normal sex, we didn’t do anything crazy. It was a little disappointing. It lasted for about 25 minutes and then we passed out." The 28-year-old reveals he was living on Hawaii’s Big Island when he met Spears at a bar on 7 June (07).
They retired to her room at the Four Seasons hotel on the KonaKohala Coast and made love. The mystery lover admits Spears had no knowledge he was filming their sex session.

Snipes was forced to pull out of the film project because federal tax fraud charges made it difficult for him to leave America. Snipes has pleaded not guilty.

O.J. SIMPSON must surrender assets including his Rolex watch to help pay off the $38 million (£19 million) he owes the families of his murdered ex-wife NICOLE BROWN SIMPSON and her friend RON GOLDMAN.
A Superior Court judge in Santa Monica, California has ordered the former American football star to also hand over any future royalties from a sports computer game, featuring Simpson, to Goldman’s father Fred Goldman.
Simpson must also give up the sports memorabilia that he allegedly acquired in a robbery in Las Vegas last month (Sep07), if authorities conclude the items belong to him.
The 60-year-old Naked Gun star was acquitted in of the murders of Brown Simpson and Goldman in 1995, but was found liable for their deaths in a civil trial in 1996.
The Goldman and Brown families claim Simpson has only paid a small portion of the money he was ordered to pay them.

Actress JANE SEYMOUR’s bid for dancing glory on TV in America has taken a stumble - the woman who inspired her to sign up for the current season of DANCING WITH THE STARS has died.
Seymour will miss Tuesday’s (02Oct07) live results show as she travels to England to be with her family following the death of her elderly mother.
The 92-year-old died in England on Monday (01Oct07) due to complications from a stroke.
Seymour recently admitted she was inspired to take part in Dancing With The Stars after her ailing mum became excited when the British beauty told her of her plans - and uttered her first words since the stroke.
In a statement, Seymour says, "My mother survived incredible challenges…
Her health issues that she never complained about… three and a half years in a Japanese concentration camp in World War II and the loss of her husband John, who was the love of her life.
"However, she was always a beacon of love and hope for all she met and especially for my sisters Anne and Sally and for our entire family. Her spirit was indomitable and will continue to live forever in our hearts."

Veteran rocker SLASH insists his new autobiography isn’t a veiled excuse for him to slam his former GUNS N’ ROSES bandmate AXL ROSE.
Slash - real name Saul Hudson - quit Guns N’ Roses in 1996 after falling out with Rose for the umpteenth time.
But the guitarist, who now plays in Velvet Revolver, claims he has tried to make sure his new book, Slash, is as even-handed as possible.

Music mogul DR. DRE wanted to "kill" the man who punched him in the face at the 2004 Vibe Awards, but is thankful his security team prevented him from doing so.
Trouble started at the hip-hop awards ceremony, where Dre was being presented with a Lifetime Achievement Award, when the veteran rapper was struck by Jimmy James Johnson.
After security pulled the assailant off Dre, Johnson was repeatedly stabbed by Young Buck - real name David Darnell Brown - during a mass brawl. Buck pleaded guilty to assault likely to produce great bodily harm was sentenced to three years probation in December 2005.
And Dre now admits he was so incensed by the humiliating incident, his initial reaction was to end Johnson’s life.
He says, "The punch was nothing - I went onstage right after; it didn’t affect me.
"The only thing that was on my mind was, ‘Kill him.’ That’s it. Fortunately, that didn’t happen. My security guys (stopped that from happening). They got him out of there.
"It was just f**king stupidity, that’s all. But he paid for it dearly. I mean, he got a cracked skull and a punctured lung. So, hey."

Police in Beverly Hills are investigating an incident at the Peninsula Hotel in Los Angeles after a security guard was reportedly assaulted by a photographer trying to snap BRITNEY SPEARS.
Spears checked into the luxury hotel on Monday (01Oct07) after losing custody of her two sons Sean Preston and Jayden James, sparking a paparazzi frenzy.
A guard at the hotel was knocked over and trampled during the chaos, and was taken to a nearby hospital to receive treatment for minor injuries.
No arrest was made, but an investigation is underway.

Actress-turned-punk rocker JULIETTE LEWIS upset caterers backstage at a recent concert in Budapest, Hungary by smashing crockery.
The Natural Born Killers star admits she got carried away at the show and felt like she had to destroy something.
She says, "Recently in Budapest, backstage at the catering area, I felt that insatiable urge and then joy at breaking dishes against a wall. I understood what that was about.
"I’m not gonna do the TV out the window at a hotel because I don’t really want lawsuits." But Lewis insists that although she’s prone to moments of wildness, she’s usually very well behaved.

COURTNEY LOVE has slammed FOO FIGHTERS frontman DAVE GROHL again, insisting her late husband KURT COBAIN "loathed" his NIRVANA bandmate.
Love and Grohl have been locked in a fierce feud over copyright for years; this manifested itself during a long-running legal dispute between Love, Grohl and Nirvana bassist Krist Novoselic over the band’s box set With The Lights Out.
They settled their legal issues in 2002 and the package was released in 2004.
But Love isn’t planning to make a friend of Grohl anytime soon, and she’s raging after her nemesis recently stated the new Foo Fighters single Let It Die is about Cobain and Love’s tempestuous relationship.
In a post on her MySpace.com page, Love writes, "As for that drummer, well he’s hit on me so many times. He’s just a very, very conflicted guy about me, which is why he continually writes songs about me to hear he ‘hates’ me more than ‘anyone else’.
"Kurt loathed him more than anyone else (except a journalist). In his will he made a codicil that Grohl was no longer a member of Nirvana. I just ignored the guy and will continue to.
"Dave knows this, and he takes it out on me! Hey, it wasn’t my band and it wasn’t my idea! It’s funny he ‘hates’ me since I don’t think about him.
"He’s just a sub-mediocre kind of (guy) who does this ‘nice guy’ nonsense.
There isn’t a word he could he say that would ruffle my feathers, honestly." Grohl recently said, "There are a lot of people that I’ve been angry with in my life, but the one that’s most noted is Courtney. So it’s pretty obvious to me that those correlations are gonna pop up every now and again." Cobain shot himself dead in 1994.

Federline was awarded ‘physical custody’ of Sean Preston, two, and Jayden James, one, in a closed-court hearing on Monday (1Oct07).
Barretto, who recently testified against the singer during her custody battle with Federline, claims the news "saddens" him, but he’s confident it’s the best decision for the children.
The minder told talk show host Larry King on Monday night, "I think that I was shocked, saddened. It’s a very sad issue all the way around. I’m happy that the kids will have some stability in the future here. I’m mixed with emotions at this point.
"I’m scared for her. I really hope her staff really keep a close eye on her." Barretto is confident his testimony that he saw Spears under the influence of alcohol and drugs, while looking after her kids, helped to sway the judge’s decision. He told King, "I think it had some weight. I’m happy that it did influence his decision. And I think he made the appropriate decision."
