The ‘Mean Girls’ star was found to be twice over the California drink-drive limit and had traces of cocaine in her bloodstream at the time of the crash in Hollywood’s Sunset Boulevard on May 26, according to a toxicology report.
Police could now present the new evidence to the Los Angeles District Attorney.
The police report filed at the time of the crash noted a "usable amount" of cocaine in Lohan’s Mercedes Benz and the actress was later arrested for driving under the influence of alcohol.
The 20-year-old star, who is not yet old enough to legally drink in the US, fled the scene and was later taken to hospital to be treated for minor injuries. Police officers then arrested her a few days later.
Soon after the incident, Lohan checked into rehab at Malibu’s Promises Centre, where she recently opted for an extended care programme.
Lohan’s lawyer Blair Berk said: ‘It’s highly inappropriate for me to discuss a pending case. It is extremely unprofessional for law enforcement to do it.’

The ‘Smile’ singer was formally arrested and questioned by police yesterday (28.06.07) over allegations she launched a Kung Fu attack outside a London nightclub in March.
Lily arrived at London’s West End Central police station with her solicitor. She had her photograph taken and gave a DNA sample before being bailed.
A police spokesman said: ‘A 21-year-old woman attended the station by appointment.
‘She was arrested in connection with an allegation of assault and bailed to return in July.’ Lily allegedly tried to kick photographer Kevin Rush and punch another lensman outside a Soho nightspot on March 12.
Rush, who made a complaint to police, said: "She went berserk." Meanwhile, Lily has been having erotic dreams about other women.
The star, who is currently dating DJ Seb Chew, is starting to think she could be "gay".
Lily said: "I have been having a lot of lesbian dreams lately. I think I might be gay! Don’t tell my boyfriend. "I have guy dreams and girl dreams, but the girl dreams are much dirtier."

Before jetting out to the idyllic destination Paris took out a lease on a $2.9 million Malibu beach house for the summer.
The 2,258 sq ft two bedroom house is described as being "right on the water", and has three bathrooms.
‘The Simple Life’ star’s parents Kathy and Rick Hilton, are reportedly planning to rent their own summer house nearby. Paris told US chat show Larry King on Wednesday (27.06.07) she was doing a "couple of movies this summer".

The troubled singer - who was reported to be planning to file a restraining order against mother Lynne earlier this week - arrived at the set of her sister Jamie Lynn’s California TV show and handed her mother two white pieces of folded paper.
In a video obtained by Splash news, Lynne looked stunned as she read through the paperwork, and had a heated exchange with Britney during which the ‘Toxic’ singer threw her hands up in the air.
Britney waved and smiled to photographers as she returned to her car.
The 25-year-old star allegedly visited her attorney to make enquiries about the order last week in an attempt to keep Lynne away from her two sons.
The paperwork allegedly claims Lynne is abusing prescription pain medication and should not be allowed to see 21-month-old Sean Preston and nine-month-old Jayden James.
Britney is said to blame Lynne for forcing her to enter rehab earlier this year to seek help for her alleged alcohol addiction and post-natal depression.
She is also said to be livid her mother sided with her estranged husband Kevin Federline during the couple’s custody battle.
The Los Angeles Superior Court says they have no knowledge of any papers filed by Britney.
Meanwhile, Kevin is delaying signing final divorce papers over concerns for Britney’s recent erratic behaviour.
A source told People magazine: ‘Britney’s attorneys are anxious to see Kevin sign off on a divorce. But Kevin and his lawyer Mark Vincent Kaplan are dragging their heels out of concern over reports of Britney’s post-rehab partying.
"Kevin’s camp want to make sure the divorce document makes it simple enough for Kevin to downsize Britney’s access to her kids the next time her behaviour troubles him.’ Kaplan refused to comment on the couple’s divorce.

The ‘Little Black Book’ star also reportedly claimed her husband – British screenwriter Simon Monjack – was kidnapped for 10 days in April by agents of her supposed stalker, according to Brittany’s former member of staff.
The unnamed male ex-employee told the New York Daily News newspaper: ‘When he came back, he had head injuries. He was pale and sometimes had trouble standing.’ The 29-year-old actress then reportedly told the former member of staff she could not pay him because she had used all her money for the ransom.
However, the dates of the alleged kidnapping coincide with tabloid reports that Monjack was jailed by US immigration authorities for overstaying his visa.
Brittany was rumoured to have married the ‘Factory Girl’ screenplay writer to stop him being deported from the US.
According to reports, Monjack was arrested on expired visa charges in the middle of the night on March 27 - just weeks before the couple’s secret wedding.
A source told the New York Post newspaper: ‘Brittany knew nothing about any of that.’ Monjack’s lawyer said: ‘These charges are being made by disgruntled ex-girlfriends and immigration officials have concluded the marriage had no bearing on my client’s visa status.’ The couple, who began dating last year, tied the knot at their Los Angeles home in front of close family and friends in May.
Brittany’s representative said: ‘They were married at their home in Los Angeles several weeks ago in a very intimate ceremony. It was officiated by a rabbi and they were surrounded by their families.’ The ‘8 Mile’ star insists the deportation rumours are ‘preposterous lies.’ Brittany told In Touch Weekly magazine: ‘Everything was just so fabricated and hurtful.’

The British actor, who won critical acclaim for his portrayal of 007 in ‘Casino Royale’, insists he doesn’t want to make "spy films" forever and is interested in a variety of roles.
He said: "I don’t just want to make spy films and I’ve never made movies just for money either." Craig, 39, has already signed up for a second outing as the suave spy in the tentatively titled ‘Bond 22′, which is due for release in November 2008.
‘Monster’s Ball’ filmmaker Marc Forster was recently announced as the director of the next 007 instalment.
Forster, who also helmed ‘Finding Neverland’, will write the script with ‘Crash’ director Paul Haggis - who helped pen the last movie ‘Casino Royale’.
Forster said: ‘I have also always been a Bond fan, so it is very exciting to take on this challenge. The new direction that the Bond character has taken offers a director a host of new possibilities and I look forward to working with Daniel Craig.’

The rapper-and-actress did not attend the Los Angeles court hearing but her attorney Blair Berk entered the plea and said she admitted to driving with a .08 percent blood alcohol level or higher when she crashed her car on April 26. Berk said: ‘She’s a very gifted artist and she is treating this with appropriate seriousness.’ As part of the plea bargain the prosecution dropped two other charges of driving impaired and driving without proof of insurance.
The 28-year-old – real name Eve Jeffers - must stay sober for 45 days and wear an alcohol-monitoring device on her ankle during that time.
Eve was fined $1,400 and placed on three years’ informal probation.
She must also attend a series of classes for first-time drunk-driving offenders.
At an initial hearing in May, Eve’s lawyer pleaded not guilty to the DUI (driving under the influence) charge on her behalf.
Eve crashed her gold Maserati into Hollywood Boulevard’s central reservation in the early hours of April 26.
She had two passengers in the vehicle at the time and was arrested at the scene.

Daniel Radcliffe was greeted by screaming fans as he arrived on the red carpet before the first showing of his much-anticipated fifth outing as the boy wizard.

The band officially announced they were reuniting yesterday (28.06.07) for an 11-date tour starting in December and a greatest hits album.
But Mel admits she and the other girls – Emma Bunton, Geri Halliwell, Mel B and Victoria Beckham – could perform more shows for fans that miss out on the first 11 concerts.

Ministry officials revealed they haven’t received an official request to film Tom’s new movie ‘Valkyrie’ in the country, but insist they would ‘look agreeably’ on any application. Earlier this week, it was reported Cruise would be banned from using German military bases to shoot the movie - which tells the true story of a failed plot to assassinate Hitler - following concerns over his association with Scientology.

Kelly said: ‘My hope is to make a film that is incredibly suspenseful and broadly commercial, while still retaining my artistic sensibility.’ Media Rights Capital (MRC) is set to fund the entire $30 million-plus budget and are confident ‘The Box’ has the potential to become a huge hit.
Modi Wiczyk, who founded MRC, said: "The storyline has all the commerciality of ‘The Ring,’ but with Richard and Cameron, this film can rise to the level of ‘Rosemary’s Baby’ and ‘The Others’." Production is set to begin this autumn.

The singer-and-actress is said to have dropped at least two dress sizes and lost almost 20lbs in eight weeks.
Pasternak told the New York Daily News newspaper: ‘I don’t use a tape measure or the scales. Weighing and measuring don’t create a lifestyle change.
