The attorney appointed for ANNA NICOLE SMITH’s baby daughter has been awarded the late model’s remains with a Florida court’s recommendation to bury her next to her son DANIEL in The Bahamas.
Baby DANNIELYNN’s legally-appointed guardian, RICHARD MILLSTEIN, will now make a final decision as to where Smith will be buried after consulting with the late celebrity’s mother, VIRGIE ARTHUR, her companion HOWARD K. STERN and ex-boyfriend LARRY BIRKHEAD.
In an emotionally-charged Florida courtroom yesterday (22FEB07), Circuit Judge LARRY SEIDLIN broke down as he signed the order to release Anna Nicole’s remains, sobbing, "She had to live all of her years under this kind of exposure. I just get a week and a half of it and it’s ready to flatten me down." In awarding Millstein the remains, tearful Seidlin added, "This is not a happy moment. I want her buried with her son in The Bahamas. I want them to be together. She’s gonna be with her son." Earlier yesterday, the dramatic Judge told the court, "I have suffered with this (case), I have struggled with this. I have shed tears." Seidlin’s decision was somewhat of a surprise - many expected the judge to award the remains to Smith’s mother, who wanted to bury her daughter in her native Texas, or Stern, who both sobbed as the ruling was read out.
Stern fought to bury Smith’s remains in The Bahamas but his custody bid for the corpse was denied.
Meanwhile, as the fight continues over the paternity of baby Dannielynn, Seidlin washed his hands of the battle, concluding, "I hope to God that you guys give the kid the right shot." Bosses at Vivid Entertainment have been trying to convince the interior designer to let them cash in on the sexy tape on her behalf, but Kardashian is determined to keep the intimate footage private.

BRAD PITT and ANGELINA JOLIE have filed paperwork to adopt a boy from Vietnam, according to press reports in the US.
The pair have three children, MADDOX, five, ZAHARA, two and SHILOH, nine months.
A source in Vietnam tells American publication US Weekly the couple have filed papers with the US Citizenship and Immigration services to adopt a boy from the Tam Binh orphanage in Ho Chi Minh City, which they visited in November (06).
The pair have long been vocal about their desire to raise more international children.
Their son Maddox is was born in Cambodia, while daughter Zahara was born in Ethiopia.
Jolie said recently, "If we’re going to have ten kids, we’d like to raise them while we’re young."

Pop star JESSICA SIMPSON has donated a minivan she won at the MTV Video Music Awards last year (06) to an orphanage in Mexico.
The 26-year-old won a Chrysler Crossfire sports car at the show and asked the car company if she could exchange it for a minivan for the Casa Hogar Elim orphanage in Nuevo Laredo.
A source tells American publication People, "Last week, someone asked MAMA LUPITA (who runs the orphanage) if she could use a van. Mama Lupita said, "Of course we could use it!’ "So then she was told that she was getting a brand new seven-passenger van from Jessica Simpson. She started to cry for three minutes straight and then said, ‘I can’t wait to give Jessica a big hug!’" The singer is also auctioning off the sexy red dress she wears in her new Pizza Hut commercial, which debuted during the US Super Bowl.
The source adds, "She’s selling the dress on (online auction site) eBay.
Proceeds from the dress will also go to help Casa Hogar.

LATEST: An attorney for ANNA NICOLE SMITH’s estranged mother VIRGIE ARTHUR collapsed in court today (22FEB07), reportedly suffering from diabetic shock.
Florida Circuit Judge LARRY SEIDLIN ordered a break in the proceedings after lawyer JOHN O’QUINN fell ill and the incident disrupted the case.
Judge Seidlin has said he will rule on who will receive Smith’s remains by Friday (23FEB07), so her embalmed body will not decompose too much for a public viewing.
Smith’s mother is seeking to bring her body back to her native Texas, while the late model’s companion and attorney HOWARD K. STERN is fighting to bury her remains in the Bahamas, next to her deceased son DANIEL.
Earlier in today’s court proceedings, Smith’s ex-boyfriend LARRY BIRKHEAD testified that he attempted to curb the former Playboy Playmate’s use of prescription drugs. Birkhead said when he visited Smith in the Bahamas at the home she shared with Stern last year (06), he became increasingly concerned about her drug use.
He said Stern told him Smith needed the prescriptions to live and when Birkhead suggested she enter a drug rehabilitation programme, Smith told him, "I’m not a drug addict and quit calling me one." The court also heard testimony from TROY HOLLIER, an ex-security employee and driver for Smith, but Judge Seidlin discredited Hollier’s testimony, saying that he wasn’t convincing and told attorneys for Stern, who called him as a witness, that he wasn’t believable. He then dismissed him from the witness stand. Smith died in a Hollywood, Florida hotel suite on 8 February (07) at the age of 39.
