Two historians today (16JAN07) launched an appeal to overturn a ruling that author DAN BROWN didn’t plagiarise their work for his bestseller THE DA VINCI CODE.
MICHAEL BAIGENT and RICHARD LEIGH were both at the hearing in London’s High Court. They claim Brown copied their book THE HOLY BLOOD AND THE HOLY GRAIL.
However, a judge ruled last April (06) that the themes in their work are too general to be protected by copyright.
Brown made an appearance in court during the original hearing, but is not expected to do so for the appeal. Last year, he argued that authors must be allowed to reference historical sources without fear of a lawsuit.
The appeal is expected to finish by Friday (19JAN07) with a decision following in writing.

Veteran Pakistani actress ZEBA ALI was asked to leave India after officials discovered she didn’t have a visa when she arrived at the holy city of Ajmer yesterday (15JAN07).
The 63-year-old insists the incident is a misunderstanding as she had visas for two other cities and didn’t realise she was not in the possession of the correct paperwork to visit Ajmer.
She says, "It was not a case of violation but a human mistake. I applied for a visa for three cities - Delhi, Ajmer and Roorkee - but I was under the impression that Ajmer had been included.
"I am going back to my country. It is an unfortunate incident."

Bollywood star SHILPA SHETTY is at the centre of a race debate after viewers of hit UK reality show CELEBRITY BIG BROTHER complained the contestant was the victim of bullying.
Shetty, who is appearing on the programme alongside JERMAINE JACKSON and former A-TEAM star DIRK BENEDICT, has allegedly been subject to a torrent of racial abuse since she entered the sealed compound earlier this month (JAN07).
Britain’s media watchdog Ofcom has received more than 2,000 complaints after the glamorous star’s accent was mocked by housemates and she was taunted by evicted contestant JACKIEY GOODY as "the Indian".
However, the show’s broadcaster Channel 4 denies the situation is spiralling dangerously out of control.
A spokesman for the programme says, "We take this matter very seriously. Big Brother does not tolerate bullying or racist abuse.
"We are monitoring all the housemates and will take appropriate measures to reprimand such behaviour where necessary.
"The social interactions and dynamics of the group are one of the key parts of the Big Brother story and viewers have a right to see these portrayed accurately.
"However, this is balanced with our duty not to broadcast material that may cause unjustifiable offence."

Hollywood actress SIENNA MILLER has rubbished reports she has been enjoying a romance with LEONARDO DiCAPRIO.
Miller, who finally split from her boyfriend JUDE LAW near the end of last year (06) following an on/off relationship, and DiCaprio were said to have canoodled at a Los Angeles nightclub recently.
However, Miller claims she had not seen DiCaprio for 18 months until last night’s (15JAN07) Golden Globe Awards.

NAOMI CAMPBELL pleaded guilty today (16JAN06) to assaulting her former maid with a mobile phone during an argument over a pair of missing jeans.
Maid ANA SCOLAVINO was treated for a head injury following the incident in the supermodel’s Manhattan, New York City home last March (06).
Campbell, 36, told Manhattan Criminal Court, "I threw a cell phone in the apartment. The cell phone hit Ana.
"This was an accident because I did not intend to hit her." Following her guilty plea, Campbell was ordered to pay Scolavino’s medical expenses, complete five days of community service and attend an anger management class.

The ‘Taking Lives’ actor - who was described by Kylie as "the most honourable man I’ve met" during her illness - insists he did everything he possibly could for his lover.

The British-born comic star insists the offensive fictional Kazakhstani reporter is now too famous to fool anyone again, but has revealed he is already working on new ideas.
Cohen - who was named Best Actor in a Film Musical or Comedy at last night’s (15.01.07) Golden Globe Awards - said in an interview with a US radio station: "I think it will probably be impossible to do Borat again. There are a number of things that are in development. The next thing will probably be a scripted comedy. I think the days of me going undercover are probably over." Cohen, who is engaged to ‘Wedding Crashers’ actress Isla Fisher, has reportedly signed a £22 million deal with Universal Pictures to star as Bruno - a flamboyant gay Austrian fashion reporter who, similarly to Borat, would go undercover to infiltrate the fashion world.
Hollywood insiders are concerned Cohen’s decision could jeopardise the deal.
A source said: "They were banking on him coming up with another Borat. There ’s no guarantee people will flock to see something that is scripted." Cohen, 35, admits he found it tough playing Borat in the movie, ‘Borat: Cultural Learnings of America for Make Benefit Glorious Nation of Kazakhstan’.
He explained: "It was tiring having to stay in character, usually for about eight hours at a time, so as not to raise suspicion.
"There is a lot of physical preparation. I never washed the suit - when I come in the room there’s this terrible smell. And Borat doesn’t wear any deodorant."

Rockers KILLSWITCH ENGAGE were forced to postpone three European dates earlier this month (JAN07) after guitarist ADAM DUTKIEWICZ was taken to hospital for emergency surgery on his back.
The American band postponed their British concerts in London and Bristol, as well as a gig in Paris, France.
Killswitch Engage have apologised for postponing their Saturday (13JAN07) show at London’s Brixton Academy just hours before they were due to take the stage. This date has now been rescheduled for 29 January (07).
A statement reads: "Following months of recuperation after previous back surgery for a herniated disc, Adam had been touring in the US with little to no incident, but after a week of shows in the UK, the guitarist found himself suffering increasing back pain, spending the time before and after shows lying flat with a bag of ice on his lower back, in an effort to continue touring.
"To make matters worse, vocalist HOWARD JONES was suffering from a chest infection.
"After a series of tests in hospital, Adam was informed his back injury was so severe, he could definitely not continue the European tour, nor fly home and would in fact need urgent surgery.
"Killswitch Engage had no choice but to postpone their shows in London, Bristol, and Paris while a Plan B was devised. Naturally, the band was worried about Adam and extremely disappointed he would not be able to finish the tour."

LATEST: JAMES BROWN’s will was drawn up 10 months before the birth of his five-year-old son and over a year before his marriage to his widow TOMI RAE HYNIE, according to reports.
Hynie has been fighting allegations her marriage wasn’t legal since the Godfather Of Soul died on Christmas Day (25DEC06), after Brown’s family attorneys claimed he told them of his suspicions the boy isn’t his biological son.
STROM THURMOND JR, Brown’s probate attorney, reportedly told a reporter for The Augusta Chronicle the will was signed on 1 August 2000.
The soul star’s six other children - who are named in the will - even attempted to cut Hynie and her son out of their father’s funeral plans last month (DEC06), suggesting the marriage was a sham.
Emotional Hynie, who was in rehab addressing her painkiller addiction when Brown died, has gone public on various US news shows declaring her marriage was legal and Brown is the father of her son JAMES BROWN II.

Actresses FELICITY HUFFMAN and CATE BLANCHETT suffered a close shave at the Golden Globe Awards last night (15JAN07) when a thief walked away with a collection of designer shoes intended for the event.

Actress JESSICA SIMPSON was stunned when the manager of her local food store asked her not to shop during normal hours - because it was distracting his customers.
THE DUKES OF HAZZARD star, 26, insists she wasn’t angry at the manager, but that fame was stopping her from carrying out such normal activities.
She says, "Two weeks ago, I was at Whole Foods and probably about 100 photographers were outside waiting for me.
