JUDGE THROWS OUT PART OF BEACH BOY LAWSUIT
LATEST: A Los Angeles judge has dismissed part of former BEACH BOY MIKE LOVE’s $2 million (£1.1 million) lawsuit against ex-bandmate AL JARDINE.
Legal papers filed by Love in 2003 allege Jardine has illegally performed under the BEACH BOYS name.
Superior Court Judge JAMES R DUNN threw out claims of breach of contract and breach of fiduciary duty on Wednesday (13SEPT06), but gave Love’s lawyer a chance to amend the case before it goes to trial in November (06).
The lawsuit claims Love, 65, is the only person legally allowed to perform under the Beach Boys name, but Jardine, 64, had toured with "knock-off bands" using names such as BEACH BOYS FAMILY & FRIENDS.
In 2001, Jardine filed a $4 million (£2.2 million) lawsuit against Love and the Beach Boys’ Brother Records Inc, alleging Love had excluded him from concerts that year. The complaint was eventually dismissed. Love formed the Beach Boys in Hawthorne, California, in 1961 with BRIAN WILSON and Jardine, and Wilson’s brothers CARL and DENNIS.
