DALLAS, May 7 /PRNewswire/ -- Dallas' Darrell W. Cook & Associates is announcing a Dallas court order requiring Braden Power of Dallas' Power Properties Management Inc. to turn over his interests in the successful real estate company he co-founded with his brother in order to help satisfy a California arbitration award.
The order issued late Friday, May 4, requires Mr. Power to turn over his interests in Power Properties to the Dallas County Sheriff's office by June 4. Those interests will then be sold to help satisfy a $600,000 judgment
entered against Mr. Power last year.
Attorneys from Dallas' Darrell W. Cook & Associates are representing Kathia Molina in the legal action against Mr. Power, who sold a $2.45 million home to Ms. Molina and her husband Fausto Zapata in 2004.
The home located just outside Los Angeles had just undergone massive renovations under the direction of Mr. Power, who lived at the residence for two years before the sale. In meetings with the couple, Mr. Power said he spent more than $1 million on high-end renovations.
However, according to the couple's lawsuit, not everything was as it first appeared. Shortly after moving in, Mr. Zapata and Ms. Molina went on vacation. When they returned, they discovered that a series of rainstorms had resulted in water coming into their new house through the windows, roof and walls.
After unsuccessfully attempting to convince Mr. Power to pay for repairs, the couple filed a lawsuit in California Superior Court in 2005. Following an arbitration proceeding in May 2006, Mr. Power was ordered to pay the couple more than $600,000, less approximately $150,000 the couple received from their insurance company. The award included more than $300,000 the couple spent to repair the house, and more than $70,000 for their living expenses while the house was being repaired and to replace rain-damaged personal property.
When Mr. Power failed to pay, the couple hired Mr. Cook to domesticate the California judgment in Texas and to collect the judgment. Now, Mr. Power has been ordered by Dallas County Court at Law judge to turn over his interests in the company he founded to set things straight with Ms. Molina and her husband.
