Concerned Shareholders Tell Biovail Employees Their Votes Can Be Confidential in Note Posted on Website

- Instructions on how employees of Biovail (NYSE: BVF) (TSX: BVF) can vote their shares without management learning how they voted was today posted on abetterbiovail.com, the website sponsored by dissident slate of directors mounting a proxy contest to unseat the incumbent management and Board of Directors of Biovail.

According to the website, employees who hold their shares through a broker, bank or other intermediary are non-registered or beneficial shareholders and thus, their identity is shielded. The website points out, "It's quite simple--call your broker and tell him or her to vote the YELLOW proxy." The website goes on: As a shareholder, the employee (and other holders) should have by now received by mail meeting materials, including a proxy

circular from the Concerned Shareholders of Biovail and a YELLOW voting instruction form or VIF. The purpose of the VIF is to allow you to confidentially direct your broker as to how you want to vote the shares that you beneficially own.

In order to confidentially vote your shares, employees need to simply follow the instructions on the YELLOW VIF. To vote for the director nominees proposed by the Concerned Shareholders, only vote your YELLOW VIF. However, if you have already voted a proxy or VIF for management, you can automatically revoke that vote by voting a later dated YELLOW VIF. You may vote by internet, telephone, mail or fax.

To vote by internet, go to www.proxyvote.com and enter the 12-digit control number that is found near the top left of your YELLOW VIF. A screen will then come up allowing you to vote online.

To vote by telephone, call 1-800-474-7493 (English) or 1-800-474-7501 (French) from a touch tone phone. To cast your vote, you will be prompted to enter the 12-digit control number found near the top left of your YELLOW VIF. Follow the rest of the prompts to complete your voting.

To vote by mail, simply complete the YELLOW VIF and mail it using the return envelope provided.

To vote by fax, simply complete the YELLOW VIF and fax it to either 905-507-7793 or 514-281-8911.
